To procure through a non-profit distributing model (NPD) the delivery of, including the design, construction, financing and maintenance of a new facility for a stand-alone Acute Mental Health and North Ayrshire Community Hospital.
The Project will include: the provision of facilities and infrastructure for approximately 206 beds, plus clinical supporting facilities; an energy centre to service the facility; installation and commissioning of mechanical and electrical engineering installations and Information and Communications Technology (ICT) infrastructure. The Project will also include (but not be limited to) reactive and planned building and engineering maintenance, associated helpdesk facility, hard landscaping maintenance, utilities procurement and management, external building fabric maintenance, and supply of some items of equipment, excluding specialist medical.
The facility is to be delivered at a site within the existing Ayrshire Central Hospital site in Irvine. The precise scope of services will be set out in the Information Memorandum and Pre-Qualification Questionnaire document which are available through the Public Contract Scotland website portal.
The Scottish Government, through the Scottish Government Health Directorates, has confirmed the terms under which it is prepared to provide financial support to the Authority in relation to the Project and the Authority is confident and content that these terms can be satisfied. The Authority reserves the right to consider alternative financing, funding and/or contractual arrangements to support the delivery of this Project.

Description of particular conditions: The successful Private Sector Partner may be required to actively participate in the achievement of social and/or environmental objectives in the delivery of the Project. Accordingly, contract performance conditions may relate in particular to social, environmental or other corporate social responsibility considerations. The contractor and its supply chain will be required to actively participate in the achievement of social objectives relating to participation in skills development, employment and training programme and other added value contributions to support community programmes supported by the Board. 1. The Authority is seeking a Private Sector Partner to participate and invest in the NPD Project for which the Outline Business Case has been approved by the Scottish Government Health and Social Care directorate and planning permission in principle is anticipated by early 2013.
2. Interested parties should express interest, receive and submit its Pre-Qualification Questionnaire submissions via the instructions contained within the Information Memorandum and Pre-Qualification Questionnaire which will be uploaded by Wednesday 16 January 2013.
3. A bidder’s day will be held on 1st February 2013 for those parties interested in the Project. Interested parties can register for this event via the instructions contained within the Information Memorandum and Pre-Qualification Questionnaire.
4. The facility is to be delivered at a site within the existing Ayrshire Central Hospital in Irvine. To ensure clinical efficiencies there will be clinical and operational links between the new facility and the Ayrshire Central Hospital.
5. Further to section II.2.1, the figure stated is in connection with the design and construction aspects of the Project.
6. Further to section II.3, the anticipated duration is 300 months of operational phase plus 21 months of construction phase, hence the total anticipated duration is 321 months from award of contract.

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: The Board will notify economic operators who submitted a tender or (where no deselection notification has previously been made) applied to be selected to tender, of its decision to award the contract which notification will contain among other information, a summary of the reasons why the economic operator was unsuccessful. The notification will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the Board dispatches the notice and the date on which the Board proposes to conclude the relevant contract. The bringing of court proceedings against the Board during the standstill period will automatically continue the prohibition on entering into the contract until court proceedings are determined, discounted or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the contract has been entered include the setting aside of the decision to award the contract to the winning tenderer. The bringing of court proceedings against the Board after the contract has been entered into will not affect the contract unless grounds for the imposition of special penalties under the Public Contract (Scotland) Regulations 2012 can be established. Otherwise the remedies that may be awarded by the courts where the contract has been entered into are limited to the award of damages. Economic operators are entitled to write to the Board after receipt of the notification should they require further clarification. The Board will response within 15 days of such a written request, but it should be noted that receipt by the Board of such request during the standstill period may not prevent the Board from awarding the contract following the expiry of the standstill period. Where an economic operator is dissatisfied with the Board’s response to its request for clarification, or that the contract has been concluded in breach of the Public Contracts (Scotland) Regulations 2012, such economic operator is advised to promptly seek independent legal advice.
