Hertfordshire County Council wishes to procure a Framework Agreement of external Training Providers who are accredited to RoATP (the Government’s Register of Approved Training Providers) to deliver quality apprenticeships across a variety of areas throughout Hertfordshire. We are intending to use current Apprenticeship Standards and Frameworks as defined by the ESFA.- As new Standards are added and existing Standards are made obsolete, we would expect training providers to have an adaptable and flexible approach to support the Council and Participating Bodies in delivering these. It is also our intention for new Providers to be able to have potential access to the Framework, as and when they are added to the Register of Approved Training Providers. This framework agreement is being lead by Hertfordshire County Council and will also be available for use by any District/ Borough Council as well as any dependent School in the county of Hertfordshire.

The Community Protection Directorate (CPD) brings together:

—Hertfordshire Resilience Team (Emergency Planning)
—County Community Safety Unit (CCSU).
As a result the Fire Protection, Fire Prevention, Trading Standards and the CCSU teams have combined to form Joint Protective Services (JPS). This team works closely with colleagues in HFRS delivering community safety and emergency response.
No apprenticeship frameworks/apprenticeship standards have currently been released by Government however as these become available the Council will issue a variation to this Specification to include any such requirements.

The services advertised in this notice fall under the services listed in Annex XIV to Directive 2014/24/EU of the European Parliament and of the Council and the contracting authority is not obliged to follow The Public Contracts Regulations 2015 in full. The procurement process that will apply to the services is specified in the procurement documents accordingly.

The evaluation of tenders will consist of two (2) parts, Qualification (Stage 1), and Award (Stage 2).

Stage 1 — Qualification
Qualification is a binary assessment (i.e. Pass/Fail). Any Tenderer that does not satisfy any of these mandatory requirements will be deemed to have submitted a non-compliant tender and will not proceed to Stage 2.
Stage 2 — Award
All Tenderers which have passed Stage 1 will be required to complete the costing chart in Bid Form 7.

VI.4.3)Review procedure
The Contracting Authority will incorporate a minimum 10 calendar day (when using electronic means) standstill period at the point information on the award of the Framework Agreement is communicated to tenderers. This period allows unsuccessful tenderers to challenge the decision to award a Framework Agreement before a contract is executed/signed (as appropriate). The Public Contracts Regulations 2015 (‘Regulations’) provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly and within the time limits as defined in the above regulations. Where a Framework Agreement has not been entered into the court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If the Framework Agreement has been entered into the court has the options to award damages and/or to shorten or order the Framework Agreement ineffective.
