Norfolk County Council wishes to enter into contracts (through a select list) with training providers, who are able to demonstrate that they offer high quality provision and successful outcomes and who are willing and able to commence the immediate delivery of high quality apprenticeship framework qualifications to adults with apprenticeship starts in the 2012-13 academic year.The length of each provider’s contract will be determined once their delivery profile has been agreed. Through this tender, the Council will fund training providers to deliver high quality skills training and apprenticeship qualifications at Level 2 (learners aged 19+) and Level 3 (learners aged 19-24), for all employers in Norfolk and Norfolk’s residents. From the Select List, the Council will allocate funding volumes to training providers based on the content of their tender submission.

Our intention is to procure adult apprenticeship qualifications from a range of suitable providers. The Council recognises that Applicants may wish to work together to bid for and, if successful, deliver the contract. However, where this is the case, the Council will only contract with a single organisation, which must take contractual responsibility for all aspects of service delivery. This will be an entity formed especially to contract for and deliver the services. The entity would need to be a registered as a training provider prior to any application. The Council will require appropriate financial and performance guarantees from the entity’s parent organisations.

This is a procurement for services specified in Part B of Schedule 3 of the Public Contracts Regulations 2006 (“Part B services”). Accordingly, and notwithstanding the advertising of this procurement exercise in the Official Journal, the Public Contracts Regulations 2006 (as amended) only apply in part. The procurement exercise will be conducted in accordance with the information contained in the Invitation to Tender and associated documents. The Authority has voluntarily advertised this procurement exercise in the Official Journal solely in order to reach as wide an audience as possible. The Authority has been constrained by the forms used by the Publications Office to describe the procurement procedure as “Open”. This will be a single stage procurement process, but the Authority does not bind itself to conduct the procurement process in accordance with the Open procedure, as described in the Regulations, nor to abide by any other part of the Regulations which does not expressly apply to procurements for Part B services.

Precise information on deadline(s) for lodging appeals: Norfolk County Council will incorporate a voluntary standstill period at the point information on the proposed Award of the contract is communicated to tenderers. The standstill period, which will be for a minimum of 10 Calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered in to. Aggrieved parties who have been harmed or are at risk of harm by a breach of the Council’s Obligations can take action in the High Court (England, Wales and Northern Ireland).
