The Contracting Authority intends to establish a framework agreement which will set out the headline terms under which a minimum of 3 and a maximum of 7 economic operators will be appointed according to their tender scores (as more particularly described in the tender documentation). Framework members will have the opportunity to tender for all of the work required in each of the geographic areas specified in the tender documentation in accordance with the terms set out therein.
The service required under the framework agreement consists of the provision of the following to the Contracting Authority’s property and dwellings:
(a) Asbestos surveys;
(b) Input of survey data to housing executive asbestos information management system (AIMS).
The service under the framework agreement will occur in or around occupied dwellings and in some cases in and around dwellings occupied by persons with disabilities and special needs.

All costs of responding to this Notice or participation in this procurement will be borne by the tenderer. Until the contract is formalised all discussions will be deemed strictly subject to contract. No formal agreement shall be binding until it has been signed by duly authorised representatives of both parties. The Transfer of Undertakings Protection of Employment Regulations and/or the Service Provision Change (Protection of Employment) Regulations 2006 may apply to the staff/operatives currently engaged in the delivery of these services. Tenderers are required to seek their own advice,make their own investigations (including by seeking information) and include for this in their tenders.
Tenderers will be required to submit a province wide pricing document specifying pricing applicable across Northern Ireland against notional quantities which will be used, with the quality submission to determine membership of the framework agreement.
Tenderers at the same time as submitting their tender for appointment to the framework agreement, will also be required to submit area pricing documents for one, or more of the 5 area work packages (according to the areas the tenderer wishes to bid for). The area pricing documents from members appointed to the Framework will be opened and assessed following the framework appointments, to determine the allocation of the Area Work Packages as more particularly described in the contract documents.
Tenderers should note that no framework member will be awarded more than 2 of the 5 possible Area Work Packages (i.e. there will be a minimum of 3 framework members awarded Area Work Packages under the framework agreement).

Precise information on deadline(s) for lodging appeals: The Contracting Authority shall, as soon as possible after the decision has been made, inform tenderers of the decision to conclude the framework agreement in accordance with Regulation 32 of the Public Contracts Regulations 2006 (as amended). A standstill period shall apply during which the Contracting Authority shall not conclude the framework agreement. Appeals against the decision of the Contracting Authority may be made to the High Court of Justice in Northern Ireland in accordance with Part 9 of the Public Contracts Regulations 2006 (as amended).
