VI.3)Additional information

City of Bradford Metropolitan District Council (‘the Council’) is seeking to procure a service contract with an expected duration of 12 years with a possible extension of up to a further 3 years, for the provision of services for the reception, storage, pre-treatment, recycling and energy recovery from local authority collected waste (municipal waste) arising in Bradford. The appointed service provider will be expected to provide a residual waste treatment solution to reduce reliance on landfill of municipal waste sufficient to meet the Council’s landfill diversion targets and to provide for the capture of recyclate and/or compost and value recovery from the residual municipal waste stream, including the provision of all associated off-take markets. To achieve this, the Council is seeking a treatment solution with energy recovery. The Council expects the contract to include: a 12 year operational service period from 2017/18 until 2029/30; and provision for an annual extension for a maximum aggregated period of 3 years beyond the initial 12 year operational service period. The financial value for the extension period is estimated to be in the order of 14 000 000 GBP per year. Further information on total quality and scope is available in the Information Memorandum.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10 calendar day standstill period at the point of awarding the contract.
If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2015 (SI 2015 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the contracting authority to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
