Silver Birch Academy Trust may also consider letting a contract where the provider manages only the provision of the school meals (e.g. preparing and serving the meals and contacting the supplier). See further information at V1.3.
This contract will be for a period of 48 months and will be open to other purchasers.

This opportunity is being advertised on the basis that the contract to be awarded is a framework for catering services. However, the contracting authority’s preference is that a concession arrangement is let whereby a substantial element of the economic risks of providing the catering services is the responsibility of the successful supplier. In either event, a framework arrangement will be concluded where the contracting authority has the right to extend the arrangements through calling off subsequent contracts for services or concession agreements for:
— other academies or schools which join the contracting authority’s trust; and
— within England and Wales, academies, academy trusts or maintained schools and local authorities which are not part of the contracting authority.
Services concessions are not within the scope of the procurement directives which have been translated into the law of England and Wales at the date of this notice. To the extent that the arrangement is a services concession, those expressing an interest or tendering for this opportunity should note that this notice is placed on a voluntary basis and, whilst the process will be conducted in a transparent manner, the contracting authority reserves the right to depart from the provisions of the Public Contracts Regulations 2015.
The contracting authority will be using the competitive dialogue procedure with negotiation. The contracting authority reserves the right to award the contract or concession framework on the basis of initial tenders without conducting negotiations.
The contracting authority reserves the right not to proceed, or not to award a contract for the whole or part of the proposed procurement. Neither the contracting authority nor any person on whose behalf this procurement is undertaken is to be liable for any costs incurred by those expressing an interest or tendering for this contract.
