This framework will be for accommodation, care and support services in Care Homes for adults with learning disabilities and/or autism for Scottish councils, NHS organisations and/or any Integration Authorities, or other bodies established pursuant to the Public Bodies (Joint Working)(Scotland) Act 2014 with powers to purchase such services.
It is envisaged that the framework will cover 24 hour services, including accommodation, care and support provided on an individual basis for adults with learning disabilities who have a need for support in a Care Home setting, in accordance with the National Care Standards (http://www.nationalcarestandards.org/) and national quality outcomes including but not limited to the National Health and Well-being Outcomes (http://www.scotland.gov.uk/Topics/Health/Policy/Adult-Health-SocialCare-Integration/Outcomes) and Talking Points Outcomes Framework (http://www.jitscotland.org.uk/wp-content/uploads/2014/01/Talking-Points-Practical-Guide-21-June-2012.pdf).Note: The buyer is using PCS-Tender to carry out this procurement process. Provision of Services in Care Homes for adults with learning disabilities for the anticipated period of 1.6.2015 to 31.5.2017 with an option to extend, subject to satisfactory performance and customer satisfaction, for up to a total of 24 months up to 31.5.2019. The anticipated start date of 1.6.2015 may be subject to change and will be confirmed by Scotland Excel. Services must be available to all eligible Purchasers across Scotland. The Framework Agreement will be awarded to Providers who offer the Most Economically Advantageous Tender.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established.
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: Financial checks will be undertaken to confirm the financial solvency and stability of tenderers. Scotland Excel will conduct a financial analysis for each tenderer based on reports from a financial services agency. Please note that a DUNS number is required as part of the assessment of a tenderer’s economic and financial standing. Should assessment identify any degree of risk, Scotland Excel reserves the right to request a tenderer’s last 2 years’ financial accounts.
Where tenderers do not have a DUNS number they will be required to provide copies of their last 2 years’ audited accounts (or equivalent) and the accounts of the group (if applicable).

(1) An indication of the proportion of the contract which the services provider intends possibly to subcontract.
It is a requirement of the Framework that each Care Home must be Registered and must maintain the necessary Registration with Social Care and Social Work Improvement Scotland (SCWIS) known as the Care Inspectorate, as a Care Home for adults, with conditions of Registration providing for delivery of support to adults with learning disabilities and/or autism or equivalent.
Providers must achieve a minimum quality grading of 3 or above from the Care Inspectorate in all quality themes for all Care Homes.
If at the Commencement Date any Care Home included in the tenderer’s offer has not obtained a grading of 3 or above for all quality themes at its most recent inspection, has not yet received its first inspection, or has not yet completed the Registration process, Scotland Excel reserves the right not to make an award in respect of that Care Home until confirmation of achievement of Registration and achievement of gradings of 3 or above on all quality themes is demonstrated to the satisfaction of Scotland Excel and that within 12 months of the Commencement Date of the Framework.
Services must be available to all Purchasers across Scotland.
Additionally, tenderers will be required to demonstrate and evidence their capability to deliver Services.

The scope of the services to be provided under this framework falls within the definition of a ‘part B’ service as listed in Annex II B of Directive 2004/18/EC and part B of Schedule 3 to the Public Contracts (Scotland) Regulations 2012 (‘the Regulations’) and therefore the procurement process and the framework shall not be subject to the full requirements of the Regulations. Any application of or reference to the Regulations unless clearly identified is not to be implied and should not be construed as applying any of the Regulations or bringing any of them into force.
Scotland Excel will hold tenderer information sessions which interested parties may attend. The purpose of these sessions will be to provide an introduction to the use of the electronic tendering system and provide technical guidance on completion of the ITT.
