This invitation is made on behalf of DRL and its shareholders and potentially other local authorities, public sector bodies and 3rd sector organisations in South Yorkshire, Sheffield City Region and Yorkshire & Humber Region (collectively described in this notice where the context requires as “the Contracting Authorities”) who also may wish to utilise the services of the successful Provider.

Digital Region Limited (‘DRL’) is seeking to work with an innovative organisation (‘The Partner’) who will participate in the operation, support and extension of a future proof, fully sustainable next generation broadband network.
The appointed partner will utilise the existing infrastructure to continue to provide wholesale network access and services for end user applications to rural and business communities, public sector organisations and citizens. The Partner could be a single organisation or a number of organisations who establish a consortium.
DRL are exploring with the EU commission the possibility of title transfer of network. The Partner will be accountable for all of the revenues, costs and risks associated with delivering and operating the network.
Access to the network must be on ‘an open access basis’ to all service and communications providers, and support the delivery of innovative services to both private and public sector organisations.
The Partner will be required to participate in and expedite a programme of demand stimulation, economic growth and transformational activities.
The Partner will also be expected to extend the existing coverage of the next generation network, supporting DRL’s objective for coverage in excess of 97 percent across the South Yorkshire region, including rural, remote and sparsely populated areas.
DRL together with the appointed partner will actively pursue funding options to enable extension of the network. The sources and level of the public sector contribution required will be established through the competitive dialogue process.
Any profits over and above a jointly agreed level, that have been generated through the operation of the DRL network, will be returned to DRL for reinvestment.
The contract duration will be 7 years with the option to extend for a further 3 years at the sole discretion of DRL.

The model for the delivery vehicle will be developed through the competitive dialogue process. DRL reserves the right to require groupings of contractors to take a particular legal form or to require a single contractor to take primary liability or to require that each party undertakes joint and several liability irrespective of the form of the partnership.
