The Congestion Charging and Traffic Enforcement Directorate of Transport for London (TfL) is responsible for enforcing traffic regulations for vehicle movements, parking, loading, and bus lanes, to help reduce delays and improve journey times, reliability, safety and the environment for all road users on the Transport for London Road Network (TLRN) The Congestion Charging and Traffic Enforcement Directorate manages the entire enforcement process which includes engaging with stakeholders and partners to enact protocols and legislation, developing and utilising a network of cameras and an on-street presence to capture contraventions and monitor compliance whilst also overseeing the Penalty Charge Notice (PCN) processing service. TfL currently utilise their own back office Digital Traffic Enforcement System (DTES) which has been specifically tailored to TfL’s requirement to support the management of these operations through monitoring of CCTV camera footage of contravention and non-compliance and processing of associated video data capture and external data feeds for onward transfer to a third party to manage the PCN process. DTES is operated from a TfL office located in central London and hosted at a TfL data centre. TfL require a capable supplier to provide the requisite scope of services for DTES which shall include but not be limited to the following:
— Maintenance and Support of the existing DTES System (software hardware infrastructure) including emergency and out of hours support,
— Software development (as required over the term),
— Hardware supply (as required over the term),
— Software management services and supply (as required over the term),
— Secure data management network services,
— Consultancy services.

TfL require a capable supplier to provide the requisite scope of services for DTES which shall include but not be limited to the following;
— Maintenance and support of the existing DTES System (software hardware infrastructure) including emergency and out of hours support,

— Software management services and supply (as required over the term),
— Secure data management network services,
— Consultancy services.
The service shall be required for a minimum period of 27 months with options to extend for up to a further 24 months at the Authority’s sole discretion.

The procurement process is being conducted on behalf of Transport for London (TfL). TfL is a complex organisation operating both as a Functional Body of the Greater London Authority (GLA) under the direction of the Mayor of London and as a provider of transport services. The services supplies or works may be provided to TfL and/or its subsidiaries and/or the GLA or any other authority that is subject to the requirements of either EU directive 2004/17/EC or 2004/18/EC. It is anticipated that a contract(s) will be awarded by London Bus Services Limited but any part of TfL and/or any of its subsidiaries may award Contract(s) as appropriate. The Awarding Authority reserves the right to withdraw from the procurement process and may award a contract(s) in whole, in part, or not at all as a result of the competition called for by this notice and the Awarding Authority shall not be liable for any costs or expenses incurred by any candidates in considering and/or responding to the procurement process. All discussions and meetings will be conducted in English. Tenders and supporting documents must be priced in sterling and all payments made under the contract will be in sterling. TfL and/or any subsidiary of TfL or the GLA may interview any or all companies who express an interest for tendering for this work. Precise information on deadline(s) for lodging appeals: This authority will incorporate a minimum 10 calendar day standstill period at the time that information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have two working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the address in Section 1.1.
If an appeal regarding the award of a contract has not been successfully resolved the (for Public Sector) Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the settling aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
