The value of the proposed Framework Agreement has been calculated on anticipated expenditure, but Cardiff Council offers no guarantee of volume or value in respect of any actual expenditure.

The Services being procured fall within part B of the Public Contract Regulations 2006 (as amended) and, as such, the Procurement Regulations only apply in part to this procurement. Accordingly tenderers should note that the Council has chosen voluntarily to issue this OJEU Contract Notice and for the avoidance of doubt this action shall not give rise to any further obligations other then those applicable to Part B Services under the Public Contract Regulations 2006. Never the less this procurement will follow a clear, structured and transparent process to ensure a fair and level playing filed is maintained at all times and that all tenderers are treated equally and fairly.

The Framework will be awarded for a period of 1 year with an option to extend for a further 12 months.

Description of these options: The Council retains the right to extend the framework agreement for a further 12 months before the expiry of the initial 1 year period.

This is a voluntary OJEU contract notice. The Council will use a fair, transparent and proportionate procedure with timescales and processes chosen by the Council. For the avoidance of doubt the Council will not be bound by any statutory time limits as this is a contract opportunity which for the purposes of the Public Contracts regulations is a Part B service and therefore not subject to the full extent of the Public Contract Regulations 2006, is not required to be tendered under the Public Contracts Regulations 2006 and accordingly the Council is only obliged to comply with those parts of the Regulations, which apply to part B services.
The Council shall not be responsible for any costs, charges or expenses incurred by any bidder and accepts no liability for costs, charges or expenses, irrespective of the outcome of the procurement. Please note that the Council will not meet any costs incurred by any party in responding to this notice. Responses will be treated as confidential.
The Council reserves the right to abandon, halt, postpone the procurement process at any stage and not to award the framework agreement. Accordingly bidders bid at their own cost.
Given this is a voluntary OJEU notice, bidders should note that all dates relating to the process are subject to change. The Council does not bind itself to accept the lowest or any offer and reserves the right to accept an offer in either whole or in part.
The Council is tendering this requirement electronically via http://appswales.alito.co.uk, and are using the open procedure i.e. no separate PQQ stage. Providers wishing to submit tenders will need to register on http://appswales.alito.co.uk.
Any company acquiring documents in any way other than through the portal at http://appswales.alito.co.uk may not be considered and their submission not evaluated. If you are registering for the first time, you must register your company details against the company profile and category SP99 – Other professional and bought in services. Please ensure that you also select Cardiff Council in your profile.
After you have carried out and completed the above, you will then need to search through the Bulletin Board on the portal for the tender reference 7429CCC and register your interest in taking part in the tender process. At this point you will be able to access and download the tender documents.

The last date for obtaining the tender documents will be 16:00 hours on 14th September 2012.
Tenders must be returned in hard copy in accordance with the Instructions to Tenderers. The last date for return of tenders will be 12:00 Noon on 17th September 2012.
Completion and return of the official documents in hard copy format only, by the date stated above will constitute an expression of interest.

Applicants will have the duration of the standstill period to ask further questions or bring proceedings. Such information should be sought from the contact named in Section 1.1 of this notice.
It should be noted that the Council is now automatically obliged to refrain from entering into a contract when proceedings are brought in respect of the award decision and the framework has not been concluded.
The contractor must serve the legal claim form on the Council (in accordance with rules of court) that represents the formal trigger for the Council to suspend the contract-making. Any claim should be addressed to the Council’s Chief Legal and Democratic Services Officer.
The automatic suspension remains in force until either the court terminates the suspension or the proceedings come to an end.
