Title

Montrose Beach Phase 3 – Framework Fencing Contract

2.2

Description of the goods or services required

The requirement is for installation of Cleft chestnut pale fencing along the back of the beach, at the toe of the dunes, for approximately 500m at Montrose Bay. A copy of the tide table will be made available to the contractor. No works are proposed to take place on the dune face. Stability of the dune face is the responsibility of the contractor. The contractor is to ensure any excavations undertaken onsite are safe and secure at all times.

The installation of the Cleft chestnut pale fencing is part of Phase 3 of the Montrose Beach Environmental Development Plan, which has been undertaken to asses the impact of coastal processes and erosion in Montrose Bay. The Supplier will be required to provide a service to repair and re-install the Cleft chestnut pale fencing within 48 hours notification from the Purchaser for the duration of the contract (including maintenance period).

The Cleft chestnut pale fencing is to be 1220mm high, with 3 wire strands. Fence is to have a solid to void ratio of 30-50%. Strainers and intermediate posts (DN175) are to be 2440mm long with 1220mm buried in the ground. Spacing between strainers is to be 70m. The maximum spacing between strainers and intermediate posts and intermediate to intermediate posts is 5m. All strainer posts are to have rounded (DN100) struts buried 600mm into the ground. Please see detail of proposed fencing on drawing 01.

All Cleft chestnut pale fencing is to comply with Angus Councils Timber Pledge policy.

It is recommended that Suppliers visit the site during the tender period to familiarise themselves with access to the site (from Trail Drive, Montrose).

3 Conditions for Participation

3.1

Minimum standards and qualification required

Prices quoted in the Pricing Schedule are fully inclusive of all costs with the sole exception of VAT. Prices are quoted on the basis of full compliance by the [Supplier] with the Specification of Requirements. Any estimated quantities referred to below are estimates only and are not warranted so the Council does not guarantee these or any levels of demand or orders. All prices are quoted as at the last date for return of tenders and remain valid for the period set out in the Tender Offer.

Where volumes or quantities of expected demand are given, no warranty is expressed or implied that these volumes or quantities of demand will be fulfilled unless the volumes or quantities are expressly stated to be firm commitments by the Council in this Specification of Requirements.

Where any technical standards, e.g. European or International Standards Organisation standards (EN or ISO numbers) or British Standards (BS numbers), are specified as essential requirements the Purchaser will accept compliance with equivalent standards and the words “or equivalent” are taken as implied into the relevant specification but subject always to the following provisos:

(a) The onus of proof of equivalence rests solely with the Supplier who will require to discharge that onus and at its sole expense to the Council’s entire satisfaction.

(b) Where scientific or technical tests or reports are relied on in support of proving equivalence of an alternative standard, the Supplier is required to provide the Council with original or certified true copies of such tests or reports along with a certified true translation into English language where the principal is not in English.

(c)The Supplier is also required to produce suitable certification from the government or other official body responsible for regulation of the alternative standard supporting the claim of equivalency and gain translated into English where necessary.

(d) All of the foregoing is without prejudice to the Council’s entitlement to seek clarification of any aspect of the Supplier’s tender (including claims of compliance with equivalent standards).
