General Medical Practice patient administration and clinical systems delivered as a managed service, together with associated services (including, but not limited to; implementation, development, testing, support and training services) and optional software modules (‘GP IT Managed Services’). The services are to be made available pursuant to a framework to general medical practices (‘GP’) or premises from which GP or primary medical care services are provided. The IT needs of NHSScotland require to be met on a flexible basis to address its evolving business and clinical requirements and to deliver the benefits of improvements in technology. This will result in both changes to service provision and the requirement for additional administrative and clinical services, for which systems may require to be hosted and supported over the Term.

II.2.4)Description of the procurement:

It is the intention of NSS to enter into a multi-supplier framework agreement pursuant to which General Medical Practice patient administration and clinical systems are to be delivered as a managed service. Call off contracts awarded under the framework agreement may be entered into to deliver services to entities constituted pursuant to the National Health Service (Scotland) Act 1978, local authorities, to entities constituted pursuant to the Public Bodies (Joint Working) (Scotland) Act 2014, the Scottish Prison Service, GP practices or premises from which GP or primary medical care services are provided. Such call off contracts may be entered into after mini competition or by direct award. Call off contracts shall have a term of seven (7) years, with a possible extension of up to three (3) years. Call off contracts will be by NSS on behalf of all Health Boards within whose geographical areas GPs are located.

This section refers to Section B of Part IV of the ESPD and covers questions 4B.2 — 4B.6.1 of the ESPD (Scotland) and responses will be assessed on a pass/fail basis:

4B1.2 — Bidders will be required to have an average yearly turnover of a minimum of 1 500 000 GBP for the last 2 years.

4B.2.2 — Bidders will be required to have an average yearly turnover of a minimum of 1 500 000 GBP in the business area covered by the contract for the last 2 years.

4B.4 — Bidders will be required to state the value(s) for the following financial ratio(s) from their most recent set of accounts: Current Ratio (i.e. Current Assets/Current Liabilities) > or = 1.1 over the last two years.

It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:

Employer’s (Compulsory) Liability Insurance = 5 000 000 GBP

Public Liability Insurance = 10 000 000 GBP

Professional Indemnity Insurance = 5 000 000 GBP

III.1.3)Technical and professional ability

List and brief description of selection criteria:

Bidders must demonstrate that they have a sufficient and appropriate general and relevant experience to perform Call Off Contracts under the Framework Agreement and the extent of experience necessary to deliver the range of the managed services all as described in this Contract Notice.

Minimum level(s) of standards possibly required:

4C.1.2 — Bidders should provide relevant examples of projects in the last three years where they have delivered services similar to those described in II.1.4 Short Description covering the criteria below which will be considered by NSS for the purpose of assessing general and relevant experience.

4C.2 — Bidders will be required to provide examples that demonstrate that they have the relevant technical ability to deliver the services as described in part II.2.4 of the OJEU Contract Notice. For example:

Accreditation to NHS Digital GP System of Choice (GPSoC) framework, or equivalent. Please provide details of your GPSoC accreditation status and list products accredited.

4C.6 — Bidders will be required to confirm that they and/or the service provider have the following relevant educational and professional qualifications:

ISO 27001 or equivalent,

PRINCE2 or equivalent,

ITIL qualifications [Service Desk, etc.] or equivalent,

Other professional qualifications relevant to the services outlined in the Contract Notice.

Bidders will be required to confirm whether they intend to subcontract and, if so, what proportion of the contract.

No questions from Part IV, Section D of the ESPD (Scotland) (Quality Assurance Schemes and Environmental Management Standards) will be evaluated and, accordingly, Part IV, Section D will not be scored.

VI.3)Additional information:

To expand upon Section II.1.4, bidders appointed to the framework agreement will, during the 6-12 month period following award of the framework agreement, be required to achieve a specified extent of compliance with certain functional and non-functional requirements which will all be clearly identified in the procurement documents. Upon achieving such compliance, in order to be eligible to be considered for award of any contracts under the Framework Agreement, Bidders will be required to enter into a Validation Contract with NSS. The form of Validation Contract will be comprised in the draft Framework Agreement, which will be issued with the procurement documents. The Validation Contract will also regulate on-going compliance by Bidders with any future functional and non-functional requirements notified by NSS.

It is intended that a catalogue will be created by each Bidder awarded to the Framework Agreement pursuant to which additional products and services may be purchased by NSS.

Bidders must provide flexible solutions to support data entry, audit, payment processing and reporting for national and local services and support General Medical Services contract requirements.

With regard to Section II.1.6 above this Framework Agreement is not suitable for splitting into lots. Given that NSS intends to award a multi supplier Framework Agreement, the possibility of the requirement across Scotland being delivered by different Bidders is already envisaged. The risk of further dividing the requirement into lots would render execution of the Framework Agreement and Call Off Contracts thereunder excessively technically and operationally difficult, and not cost effective.

Precise information on deadline(s) for review procedures:

Precise information on deadline(s) for lodging appeals: NSS will incorporate a ‘standstill period’ of a minimum of ten (10) calendar days (between the date on which NSS despatches the notice(s) of its decision in relation to the conclusion of a Framework Agreement to economic operators who submitted a tender or applied to be selected to tender, and the date on which NSS proposes to first conclude the Framework Agreement). This period allows economic operators in receipt of such a notice from NSS to submit a written request for debriefing information from NSS before the Framework Agreement is concluded. In the event that any economic operator submits a written request for debriefing information to NSS within two (2) working days from the commencement of the standstill period, NSS shall in response to such request, and to the extent only that it has not already done so, inform that economic operator of the reasons why the economic operator was unsuccessful, and the characteristics and relative advantages of the successful economic operator(s), a minimum of three (3) working days before the expiry of the standstill period. Such additional information should be requested from the address at section 1.1.

Where an economic operator is dissatisfied with NSS’ response to its request for debriefing information, or considers that the Framework Agreement has been concluded in breach of The Public Contracts (Scotland) Regulations 2015, such economic operator is advised to promptly seek independent legal advice.
