II.1.5)Short description of the contract or purchase(s)

The Contracting Authority intends to establish a framework with a maximum of 8 economic operators for the provision of Grounds and Tree Maintenance services.
The Maintenance Services will be required throughout Northern Ireland.
The service consists of a comprehensive grounds and tree maintenance service and associated works.
The services will be carried out in accordance with the planned programme of grounds and tree maintenance.
Also in exceptional circumstances or emergency situations the Contracting Authority may require the provision of unplanned Grounds and Tree maintenance Services.
The service will occur in or around occupied premises and in some cases in and around dwellings occupied by persons with disabilities and special needs.
The Framework Members appointed to provide Services under a Secondary Competition will enter into a Framework Contract with the Northern Ireland Housing Executive. The Framework Member is responsible for the full provision of the Services by its Team.
Following secondary competitions Service Providers will be restricted to a maximum of 2 Contracts subject to sufficient acceptable tenders being received (but may be awarded additional contracts as per contract documentation).
The Framework will consist of a maximum of 8 Service Providers subject always to a sufficient number of compliant tenders being received.
The Framework will be for a period of 4 years from the date of commencement.

Subject to the status and involvement of the parties the Contracting Authority may require parties to commit to joint and several liability in respect of the contract. Alternatively the Contracting Authority may expect the lead operator to take total responsibility. The Contracting Authority may require collateral warranties, parent company guarantees and/or performance bonds as applicable to be entered into by other economic operators.

Information and formalities necessary for evaluating if the requirements are met: Conditions for participation in the competition are set out in detail in the Tender documents. The Tenderer and/or members of the consortium must meet the requirements set out in Regulation 23 of the Public Contracts Regulations 2006.

Information and formalities necessary for evaluating if the requirements are met: Evidence must be provided to demonstrate that the Tenderer and/or members of the consortium have the financial and economic standing required for the contract, under Regulation 24 of the Public Contract Regulations 2006.

The cost of responding to the Tender and participation in the project will be borne solely by each Tenderer participating. Tenderers should note that the Northern Ireland Housing Executive reserves the right to cancel this procurement process at any stage without reason or cost reimbursement. Any expenditure, work or effort undertaken prior to entering into a Framework Agreement is at the sole risk of the Tenderer participating in this procurement process. The Northern Ireland Housing Executive reserves the right to extend any such date. The proposed duration of the Framework will be for a period of 4 years.
