Peabody may require the successful bidder to provide a performance bond or parent company guarantee.

The procuring authority reserves the right to require groups of service providers to take a particular legal form, or to require a single service provider to accept primary liability, or to require that each party undertakes joint and several liability.

Description of particular conditions: The selected service provider may be required to offer a TUPE transfer to any qualifying staff currently engaged with the delivery of the services. The selected service provider will be required to demonstrate that all relevant employees engaged in delivery of the services are qualified to an appropriate level with relevant certification bodies.
