II.1.5)Short description of the contract or purchase(s)

Devon County Council (DCC), Somerset County Council (SCC) and Plymouth City Council (PCC) are undertaking a joint procurement exercise for the provision of each Authority’s new Highway Term Maintenance Contract (TMC). The procurement includes 3 specific lots:
— Lot 1 will cover the administrative area of DCC;
— Lot 2 will cover the administrative area of SCC;
— Lot 3 will cover the administrative area of PCC.
Specifications across these lots have been standardised where possible, however lots will contain requirements which are Authority specific. The Authorities will seek to identify the potential benefits of a single provider potentially undertaking (up to) all 3 contracts; a single provider will be appointed where it is more economically advantageous to each of the Authorities, applying the award criteria published in the Invitation to Submit Initial Tenders.
The Authorities will work collaboratively with the provider(s) and each other to realise additional benefits and facilitate the successful delivery of the contracts.
The contract term for each authority will be seven years from 1.4.2017, with opportunities to extend for further periods of up to 3 further years. Additionally there will be a 6 month contractual mobilisation period for the contracts, to begin from 1.10.2016, leading up to service delivery commencement for each Lot, at 1.4.2017.

The contract term for each authority will be 7 years from 1.4.2017, with opportunities to extend for further periods of up to 3 further years. Additionally there will be a 6 month contractual mobilisation period for the contracts, to begin from 1.10.2016, leading up to Service delivery commencement for each Lot, at 1.4.2017.
The combined indicative value is in the region of up to 1 200 000 000 GBP . This value is based on best estimates, given current available information, including an allowance for ad-hoc and non routine requirements..

Description of these options: In its scope, the contract will also provide for the provision of support/ancillary services which support the operation of the Council’s Highways Service. Details are contained within the tender documents. Plymouth City Council may, at its discretion, commission the delivery of non-maintenance schemes via this Contract, typically up to a maximum individual scheme value of 1 500 000 GBP. Any decision as to whether or not to commission individual schemes in this way shall be dependent upon, amongst other things, the Contractor’s demonstration of value for money, assured quality of finished product, deliverability and compliance with programme requirements (and without adversely impacting upon the Contractor’s on going delivery of core maintenance works), and appropriate experience and ability. Examples of schemes may include, but will not be limited to, junction, roundabout and accessibility improvements, road widening, and neighbourhood, living streets and local safety improvements.

The Authorities reserve the right to cancel the procurement process at any stage. The Authorities do not bind themselves to accept the lowest or any tender, and reserve the right not to award a contract. The Authorities reserve the right to award the contract in part, or to call for new tenders should they consider this necessary. Economic Operators remain responsible for all costs and expenses incurred by them or by any third party acting under instructions from them in connection with their participation in this procurement, whether incurred directly by them or their advisors or subcontractors and regardless of whether such costs arise as a consequence direct or indirect of any amendments to documents issued by the Authorities at any time, or as a consequence of the cancellation of the procurement by the Authorities. For the avoidance of doubt, the Authority shall have no liability whatsoever to Economic Operators or their advisors or subcontractors, for any of their costs, including but not limited to those for any discussions or communications. Any contract(s) entered into as a result of this contract notice shall be considered as a contract(s) made under English law and subject to the exclusive jurisdiction of the English courts.
