HS2 Ltd requires Professional Services Consultants (PSCs) services to deliver Civils Design and Environmental services & Environmental Overview Consultant (EOC) services for Phase Two of HS2.
The contracts for the PSC services are split into 3 Lots on a geographic basis as detailed below and Lot 3 also includes the EOC services;
Lot 1 — C1000_231 — Civils Design and Environmental Services (M2 and M3 — Manchester Leg Spine and Manchester Leg Spur respectively),
Lot 2 — C1000_232 — Civils Design and Environmental Services (L1 and L2 — Leeds Leg South & East Midlands respectively) and Lot 3 — C1000_233 — Civils Design, Environmental Services (L3 and L4 — Leeds Leg Central & Leeds Leg North respectively) and Environmental Overview Consultant (EOC).
HS2 Ltd does however reserve the right to vary the scope of discrete elements of the services between Lots as outlined in Section VI.3 and the pre-qualification pack. Further information is provided in section VI.3
HS2 Ltd is the company responsible for developing and promoting the High Speed 2 (HS2) network and is wholly owned by the Department for Transport.
The HS2 network will provide high capacity, high speed rail links between London, Birmingham, Leeds and Manchester (including Manchester Airport), with intermediate stations in the East Midlands and South Yorkshire. The new high speed network is being planned and is to be built in 2 phases. Phase 1 from London to Birmingham and Phase Two, from Birmingham to Leeds and Manchester.
Phase One is not part of the scope of this procurement.
The broad project aim for Phase Two is to gain Royal Assent to a hybrid Bill that enables HS2 Ltd to construct, operate and maintain a high speed railway, with the optimum balance between cost, environmental and community impact and engineering design, for the Phase 2 route, integrating seamlessly with Phase 1 and as part of a national rail network.

Due to the resources, range and depth of skills needed to undertake the Civils Design, Environmental Services and Environmental Overview Consultant contracts, the Applicants may wish to combine to form consortia or apply as the main consultant relying on sub consultants to deliver some of the services. This may, for example, apply to entities who feel that alone they do not have the capacity or capability to address the size and scale of HS2 Ltd’s requirement. Whilst groupings of organisations and consortia can participate in the procurement without taking a specific legal form, HS2 Ltd may rely upon regulation 28(3) of the Utilities Contracts Regulations 2006 (as amended) in order to contract with a single entity.
HS2 Ltd will require organisations, by completing the pre-qualification questionnaire, to provide full details, in writing, of the proposed working arrangements.

A minimum professional indemnity insurance of 25 000 000 GBP for any one incident, without limit on the number of incidents or reduction in cover, employers liability insurance of £10,000,000 for each and every occurrence and public liability insurance of 10 000 000 GBP for each and every occurrence. Please note that HS2 Ltd is procuring in parallel the Phase Two Development Partner (P2DP). The role of the P2DP will include performance management and instructions of work to the Phase Two Civils Design and Environmental Services (P2CDES) consultants and as such an entity who provides both the P2DP services as well as the P2CDES services would be in a position to determine their own performance and instruct themselves to carry out work which presents a clear conflict of interest. Applicants are therefore not permitted to be an Applicant in both this P2CDES procurement and the P2DP procurement and may only submit a request to participate for either this procurement or the P2DP procurement. In the event that an Applicant does respond to both, they will be contacted by HS2 Ltd and the Applicant will be required to choose which of the two procurement processes it wishes to participate in. If the Applicant fails to respond to this request, they will be excluded from further consideration in relation to both procurements processes.
Where individuals or sub-contractors are proposed as part of delivering arrangements for both this procurement and the P2DP procurement, HS2 Ltd will require full details of any conflict of interest management measures (including but not limited to evidence of full and robust information barriers, separate teams with discrete management supervision and appropriate confidentiality undertakings) before deciding whether individuals or subcontractors will be permitted to work for both the P2DP and P2CDESs. Provisions around conflicts of interest will also be stated in any Contract(s) awarded.
The P2CDES consultants shall develop the Phase Two line of route and associated infrastructure in preparation for the deposit of the Phase Two hybrid Bill.
1. Civil Designs scope (Lots 1, 2 and 3): The design work shall include but not be limited to the development of the railway alignment, formation and associated infrastructure assets such as stations (including architectural services), depots, highways, drainage, construction and logistics (including mass haul), and ancillary equipment (package dependent). This civils design development shall be based on the post-consultation alignment of the route and be of a detail necessary to support the environmental impact assessment and Parliamentary Bill procedures. Civil design and engineering support will continue following the deposit of the Bill through the Parliamentary process to Royal Assent, and in preparation for the detailed design stage and construction.

The P2CDESs will be required to produce engineering information in the form of models, plans, drawings, sections, schedules, technical reports and supporting information, plus construction cost estimates in accordance with stated HS2 Ltd requirements, standards and specifications and the HS2 Design Vision (https://www.gov.uk/government/publications/hs2-design-vision). Assurance and verification evidence that the design meets these criteria will be provided by the P2CDESs at milestones during the progression of the design.

2. Environmental scope (Lots 1, 2 and 3): The P2CDESs will support HS2 Ltd in the preparation of a robust, proportionate Environmental Impact Assessment Report (EIAR) (formerly Environmental Statement (ES)) and associated assessments and documents which will form part of the hybrid Bill to be deposited in 2019. Following deposit, the P2CDESs will provide support in the consideration and scrutiny of the Bill in order to achieve Royal Assent and in preparation for handover for detailed design and construction.
The P2CDES will undertake local environmental impact assessments (including local traffic and transport assessments and support the production of the Equalities Impact Assessment (EQIA) and complete the area environmental report(s) to form part of a single robust, integrated EIAR including health assessment (compiled by the Environmental Overview Consultant (EOC)) for Phase Two.
3. Environmental Overview Consultant scope (Lot 3 only): The EOC will be responsible for: determining the Phase Two scope and methodology for assessments (as part of the Phase Two Scope and Methodology Report (SMR) as detailed in the pre-qualification pack); overseeing, coordinating and assuring the geographic environmental assessments delivered by the P2CDESs; carrying out route wide assessments; producing the integrated EIAR including health assessment, EQIA and Transport Assessment (TA); and, providing support following deposit in the consideration and scrutiny of the Bill in order to achieve Royal Assent and in preparation for handover for detailed design and construction.
The EOC will lead on and deliver the non-geographical and/or route-wide environmental assessments (such as climate, noise and socio-economics).
The EOC will oversee, co-ordinate and assure the local environmental impact assessments carried out by the P2CDESs across the west and east legs of the Phase Two route (including agreeing, applying and ensuring a common and consistent approach to assessment and reporting).
A contract duration of 90 months has been specified in section II.3. This is an estimate and the precise duration may be longer as it is dependent on external factors such as HS2 Ltd obtaining Royal Assent for the Phase 2 hybrid Bill and the requisite handover to a Phase 2 Delivery Partner.
HS2 Ltd intends to develop an incentive scheme which will link rewards to successful collaborative working and cost control and achievement of key dates to meet the Project goal of attaining Phase Two Royal Assent by late 2022 and may develop common key performance indicators, as well as meeting HS2 Ltd’s Balanced Scorecard objectives. Successful P2CDESs will be expected to work collaboratively with other professional services consultants, HS2 Ltd and the other relevant stakeholders in the project. HS2 Ltd is currently working through the detail of the above and further details of the incentive scheme will be provided at the invitation to tender (ITT) stage. HS2 Ltd reserves the right not to introduce an incentive scheme.
HS2 Ltd intends to make provision in its ITT and associated Contract(s) for a clear and unequivocal provision allowing HS2 Ltd, following contract award, to vary discrete elements of the Services between Lots. The parameters in which HS2 Ltd may undertake such variation will be stated in the ITT documentation issued to successful Applicants. Parameters for the variation of discrete elements of Services will include, but not be limited to, the capacity of each P2CDES to deliver HS2 Ltd’s requirements at any time on the Project and the Consultants performance not falling below pre-determined key performance indicator (KPI) thresholds which will be stated in the ITT.
Applicants may express an interest in Lots 1, 2 and/or 3 and may be invited to tender for one or multiple Lots. However, applicants will not be permitted to win more than one Lot and where tenderers are invited to tender for more than one Lot, they will be required to confirm their order of preference as part of their tender submission. Further details on the preferencing process and selection of the Most Economically Advantageous Tender are provided in the pre-qualification pack.

HS2 Ltd does not bind itself to enter into any contract arising out of the procedures envisaged by this notice and no contractual rights expressed or implied arise out of this notice or the procedures envisaged by it. HS2 Ltd reserves the right to disqualify any candidate who: provides information or confirmations which later prove to be untrue or incorrect; does not supply the information required by this notice or by the pre-qualification pack or as otherwise directed by HS2 Ltd during the procurement process; or fulfils any one or more of the criteria detailed in Regulation 26 of The Utilities Contracts Regulations 2006 (as amended). The total contract range of 280 000 000 GBP and 350 000 000 GBP stated in section II.2.1 and the ranges specified per Lot in Annex B are estimates. The total value of the contracts may vary in practice from these amounts dependent on the requirements of HS2 Ltd both within the 3 Lots and in total.
All prices are to be stated in GBP. Any contract arising out of the procedures envisaged by this notice will be subject to English Law.
All interested parties will be required to enter into a Confidentiality Agreement electronically prior to accessing the Pre-qualification pack and to sign and return a hard copy Confidentiality Agreement as part of any response to this notice.
