HS2 Ltd is the company responsible for developing and promoting the High Speed 2 (HS2) network and is wholly owned by the Department for Transport.
The HS2 network will provide high capacity, high speed rail links between London, Birmingham, Leeds and Manchester (including Manchester Airport), with intermediate stations in the East Midlands and South Yorkshire. The new high speed network is being planned and is to be built in 2 phases. Phase 1 from London to Birmingham and Phase 2, from Birmingham to Leeds and Manchester.
Phase 1 is not part of the scope of this procurement.
The broad project aim for Phase 2 is to gain Royal Assent to a hybrid Bill that enables HS2 Ltd to construct, operate and maintain a high speed railway, with the optimum balance between cost, environmental and community impact and engineering design, for the Phase 2 route, integrating seamlessly with Phase 1 and as part of a national rail network.

— the management of various Professional Services Contract (PSCs) consultants appointed for developing a range of deliverables that will support the deposit of the hybrid Bill for the HS2 Phase Two project anticipated in 2019, and passage of the Bill through the Parliament up to Royal Assent anticipated in late 2022; and
— the engagement and consultation requirements necessary to support the deposit of the hybrid Bill and its passage through the Parliamentary process to Royal Assent.
Please note that HS2 Ltd is procuring in parallel the Phase Two PSC consultants for providing Civils Design and Environmental Services.
HS2 Ltd has already procured framework agreements for Railway Systems Design and Site Access, Land Referencing and Landowner Engagement Services which will cover the entire Phase 2 route.
The PSC consultants will be required to produce engineering information in the form of models, plans, drawings, sections, schedules, technical reports and supporting information, plus construction cost estimates in accordance with stated HS2 Ltd requirements, standards and specifications and the HS2 Design Vision (https://www.gov.uk/government/publications/hs2-design-vision). Assurance and verification evidence that the design meets these criteria will be provided by the PSC consultants at milestones during the progression of the design as well as undertake local environmental impact assessments (including local traffic and transport assessments and support the production of the Health Impact Assessment (HIA) and Equalities Impact Assessment (EQIA) and complete the area environmental report(s) to form part of a single robust Environmental Statement (compiled by the Environmental Oversight Consultant (EOC)) for Phase Two. The PSC EOC will lead on and deliver the non-geographical and/or route-wide environmental assessments (such as climate, noise and socio-economics).
The role of the P2DP will include performance management and instructions of work to the PSC consultants and as such, an entity who provides both the P2DP services as well as the PSC consultant’s services would be in a position to determine their own performance and instruct themselves to carry out work which presents a clear conflict of interest. Applicants are therefore not permitted to be an Applicant in both this P2DP procurement and the PSC consultant’s procurement and may only submit a request to participate for either this procurement or the PSC consultant’s procurement. In the event that an Applicant does respond to both, they will be contacted by HS2 Ltd and the Applicant will be required to choose which of the two procurement processes it wishes to participate in. If the Applicant fails to respond to this request, they will be excluded from further consideration in relation to both procurements processes.
The P2DP will also support HS2 Ltd in the management of the already procured framework agreements for the Railway Systems Design Services and the Site Access, Land Referencing and Landowner Engagement Services. For the same reason as specified above for the PSC consultants, an entity which provides services under the aforementioned framework agreements is not permitted to be an Applicant (or a Party to an Applicant in the case of a Consortium) to this procurement. In the event an Applicant (or a Party to an Applicant) which provides services to HS2 Ltd under the framework agreements responds to this procurement, the Applicant will be excluded from further consideration in relation to the P2DP procurement.
Where individuals or sub-contractors are proposed as part of delivering arrangements for both this procurement and the PSCs procurement, HS2 Ltd will require full details of any conflict of interest management measure (including but not limited to evidence of full and robust information barriers, separate teams with discrete management supervision and appropriate confidentiality undertakings) before deciding whether individuals or subcontractors will be permitted to work for both the P2DP and PSCs. Provisions around conflicts of interest will also be stated in any Contract(s) awarded.
A contract duration of 90 months has been specified in section II.3). This is an estimate and the precise duration may be longer as it is dependent on external factors such as HS2 Ltd obtaining Royal Assent for the Phase 2 hybrid Bill and the requisite handover to a Phase 2 Delivery Partner.
HS2 Ltd intends to develop an incentive scheme which will link rewards to successful collaborative working and cost control and achievement of key dates to meet the Project goal of attaining Phase 2 Royal Assent by late 2022 and may develop common key performance indicators, as well as meeting HS2 Ltd’s Balanced Scorecard objectives. The successful DP will be expected to work collaboratively with other PSCs, HS2 Ltd and other relevant stakeholders in the project. HS2 Ltd is currently working through the detail of the above and further details of the incentive scheme will be provided at the invitation to tender (ITT) stage. HS2 Ltd reserves the right not to introduce an incentive scheme.

Submitting a response to the notice does not guarantee that a candidate will be invited to tender. HS2 Ltd does not bind itself to enter into any contract arising out of the procedures envisaged by this notice and no contractual rights expressed or implied arise out of this notice or the procedures envisaged by it. HS2 Ltd will not be liable in any way to any applicant or tenderer for any costs incurred in connection with this procurement process.
HS2 Ltd reserves the right to disqualify any candidate who: provides information or confirmations which later prove to be untrue or incorrect; does not supply the information required by this notice or by the pre-qualification pack or as otherwise directed by HS2 Ltd during the procurement process; or fulfils any one or more of the criteria detailed in Regulation 26 of The Utilities Contracts Regulations 2006 (as amended). The contract range of 130 000 000.00 GBP to 170 000 000.00 GBP specified in this notice at section II.2.1) is an estimate. The total value of the contract may vary from this amount dependent on the requirements of HS2 Ltd.
All prices are to be stated in GBP. Any contract arising out of the procedures envisaged by this notice will be subject to English Law.
All interested parties will be required to enter into a Confidentiality Agreement electronically prior to accessing the Pre-qualification pack and to sign and return a hard copy Confidentiality Agreement as part of any response to this notice.
