II.2.1)Total quantity or scope:

The framework will enable contracts for the appointment of construction contractors and professional services providers for a variety of housing developments and related social infrastructure schemes. The total value of the framework is estimated at 500 000 000 GBP however this is only a approximate estimate as the capital value of works will be influenced by the amount of public subsidy available and other financial considerations that impact on new build developments and affordable housing viability and supply.
Works will include the detailed design, construction, completion and commissioning of new build multi use mixed tenure housing developments and related social infrastructure schemes. The construction works include site preparation, refurbishment, new construction, associated public realm and infrastructure together with buildings associated with sustainable neighbourhoods and may include commercial, small scale enterprise.
The range of residential accommodation may embrace special needs including elements of care, support and mixed use.
Constructions is envisaged to be undertaken in urban centres, suburban and rural locations. As part of the overall construction service the works may include elements of architectural design, engineering and related support services.
The framework will include seven Construction lots divided into low, medium and high value contract bands. Low value = 0 GBP— 1 500 000 GBP, medium value = 1 500 000 GBP — 4 000 000 GBP, and high value = 4 000 000 GBP + contract value. The lots are divided further geographically within North West England covering Greater Manchester and Merseyside, Cheshire, Derbyshire West and Staffordshire, Lancashire and Cumbria, South Yorkshire and Derbyshire East, as detailed in Annexe B. There are seven further professional services lots which are outlined within the invitation to tender. The expenditure throughput for each lot detailed in Annexe B is estimated and may change either falling below or exceeding the individual lot range depending on local priorities, and site and funding availability however the total value across all lots is intended to remain within 500 000 000 GBP.

Applicants for construction lots will need to provide a commitment to one of the following for each contract awarded under the framework:
1. Performance Bond, Building Guarantee, Standard Retention of 3 % to PC, 1.5 % to MGDC, or
2. Building Guarantee with Insolvency and Enhanced Retention at 8 % to PC, 1.5 % to MGDC, or
3. Building Guarantee, Parent Company Guarantee and Enhanced Retention at 5 % to PC, 1.5 % to MGDC.

Minimum level(s) of standards possibly required: Applicants will be required to state the annual turnover of the organisation. To pass this question for the construction lot, the organisation must meet the minimum required annual turnover for the lot that it is applying for, which is as follows:

Contractors high value lot: minimum level = 10 000 000 GBP”.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: Great Places Housing Group on behalf of ICNW members and the bodies identified in section V.1.3) will incorporate a minimum 10 calendar day standstill period at the point information on the award of the framework is communicated to tenderers. This period allows tenderers to seek further information prior to the framework agreement is entered into. Applicants will have two working days from the notification of the award decision to request additional information (de-briefing) and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Information should be requested from the individual named at section 1.1) above. If an appeal regarding the award of the framework agreement has not been successfully resolved, the Public Contract Regulations 2006 provide for agreed parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought within 3 months. Where a contract has not been entered into the Court may order a setting aside of the award decision or order the authorities to amend any document and may award damages. The purpose of the standstill period above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into.
