Requests to participate may be made from grouping of economic operators (Consortia). In the event of a successful consortium bid, the contracting authority may specify that the consortium members take a particular legal form and/or require that a single consortium members takes primary liability or that each member undertakes joint and severally liability irrespective of the legal form adopted. Where a subsidiary company is used, the ultimate parent company may be required to provide a guarantee in respect of the performance of the contract by the subsidiary before acceptance.

Description of particular conditions: Selected candidates shall be required to actively participate in the achievement of social and/or environmental objectives. Accordingly contract performance conditions may relate in particular to social and/or environmental or other corporate social responsibility considerations. III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to answer these questions as part of the qualification process. For candidates who are registered overseas, you will need to declare if you have any offences/misconduct under your own countries laws, where these laws are equivalent to the Regulation 23 lists.
Candidates who have been convicted of any of the offences under Article 45(1) are ineligible and will not be selected to bid, unless there are overriding requirements in the general interest for doing so.
Candidates who are guilty of any of the offences, circumstances or misconduct under Article 45(2) may be excluded from being selected to bid at the discretion of the Authority.

(c) A statement of the undertaking’s overall turnover and, where appropriate, of turnover in the area covered by the contract for a maximum of the last three financial years available, depending on the date on which the undertaking was set up or the economic operator started trading, as far as the information on these turnovers is available

Justification for the choice of accelerated procedure: The new Scottish Fire and Rescue Services assumes powers on 1st April 2013. Approval has only recently been granted to proceed with a tender process for the provision of Insurance Services and Assciated Claims Handling Service. To ensure the provision of service is in palce and commences on the 1st April it is necessary to utilise the Accelerated Restricted Procedure.

The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.Strathclyde Fire and Rescue is undertaking this contract opportunity on behalf of the Scottish Fire and Rescue Service which assumes powers on 1st April 2013. The proposed services shall commence on 1st April 2013.

The number of Candidates invited to tender per Lot shall be a maximum of 5 Candidates. The selected Candidates shall be those meeting the minimum requirements with the highest scores. In the event that it is not possible to distinguish between the scores of more than 5 Candidates, more than 5 short-listed Candidates may be selected per Lot. In the event that less than 5 Candidates meet the minimum requirements, SFR on behalf or FRS reserves the right to select fewer than 5 to be invited to tender.

Candidates are advised that SFR is subject to the Freedom of Information Act 2000 (“the Act”).
