Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

Precise information on deadline(s) for lodging appeals: Precise information on deadline(s) for lodging appeals: Subject to Regulation 32(13) of the Public Contracts Regulations 2012 (as amended) (the “Regulations”), SDS shall by notice in writing, (“Standstill notice”)as soon as possible after the decision has been made, inform all tenderers and all candidates (if any) of SDS’s decision to award the contract advertised by this contract notice. Such Standstill notice will include all information required by Regulation 32(2) of the Regulations and it is intended that such Standstill notice will be issued electronically to all tenderers and all candidates (if any). SDS will allow a period of at least 10 days to elapse after the relevant sending date of such Standstill notice and the date on which SDS enter into the contract which is the subject of this contract notice (the “Standstill period”). The date on which the Standstill period will end will be stated in the Standstill notice. A breach of the duty owed by SDS under Regulation 47A or 47B of the Regulations is actionable by any economic operator which, in consequence of the breach, suffers, or risks suffering, loss or damage and such proceedings may be brought in the High Court and Regulations 47D to 47P apply to such proceedings. Such proceedings require to be brought in accordance with (a) Regulation 47E of the regulations which states that in the case of proceedings seeking a declaration of ineffectiveness (as defined in Regulation 47K of the Regulations): (i) where Regulation 47E(3) or (5) of the regulations applies, within 30 days beginning with the relevant date mentioned in that paragraph; or (ii) in any other case, within 6 months beginning with the day after the date on which the contract was entered into; or b) Regulation 47D of the Regulations which states that where the proceedings do not seek a declaration of ineffectiveness, within 3 months beginning with the date when grounds for starting the proceedings first arose (subject to Regulation 47(D)(3) and (4)). Any proceedings should be notified to the contact stated in section I.1 of this contract notice.
