III.1)Conditions relating to the contract
III.1.1)Deposits and guarantees required:
Parent company guarantees and/or bank guarantees may be required at International Nuclear Services Limited’s discretion.

Payment terms will be as stated in International Nuclear Services Limited’s tender documents.
III.1.3)Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
No legal form is required, but in the event of a group of contractors submitting an acceptable offer it will be necessary to provide an undertaking that each company or firm will be jointly and severally liable for the due performance of the contract.

III.2)Conditions for participation
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: a) An independent statement proving that the applicant is not bankrupt or being wound up; that its affairs are not being administered by the court; that it has not entered into an arrangement with creditors; it has not suspended business activities or that it is not in any analogous situation arising from a similar procedure under national laws and regulations or that it is not the subject of proceedings for a declaration of bankruptcy, for an order of compulsory winding up or administration by the court for an arrangement with creditors, nor is it the subject of any other similar proceedings under national laws and regulations.
b) An independent statement from the appropriate authority in the country of origin in which the applicant is established to the effect that all obligations relating to the payment of social security contributions have been paid in accordance with the legal provisions of the said country.
c) An independent statement from the appropriate authority in the country of origin in which the applicant is established to the effect that all obligations relating to the payment of taxes in accordance with the legal provisions of the said country.
d) A statement from the applicant that it is willing to enter into a contract under English Law.
e) A statement from the applicant that the applicant or any of its officers is not subject to criminal proceedings in any jurisdiction.
f) A statement from the applicant that, in the past 3 years, it has not had a contract terminated or failed to receive contract renewal on the basis of unsatisfactory performance.
g) Applicant shall confirm that, to the best of its knowledge, it is not in breach of any of the provisions of Regulation 23 of the Public Contracts Regulations 2006 (as amended).
III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: Applicant shall provide audited Company and Parent Company Annual Report & Financial Statements for the previous 2 years plus, if available, the latest interim results. (Where applicable similar information shall be provided for each joint venture/consortium partner). The Applicant shall be of acceptable financial strength based on conventional company performance/liquidity ratio analysis that is appropriate for the value of the contract to be awarded. In particular that:
(i) the annual value of the contract is typically not greater than 25 % of the company(ies) annual turnover or parent organisations (if a parent company guarantee is provided) and that,
(ii) the company does not pose a high commercial risk to INS if the contract was awarded.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
a) Applicant shall provide evidence, e.g. schedule/demonstration of performance and experience, that its Manufacturing capability is sufficient to meet the requirements of the tender for the production of ISO Containers; i.e. delivery of up to 27 off type 3573 ISO Containers with one off being delivered 5 months from Contract placement, 10 off being delivered 15 months after contract placement and completion of total order 18 months after contract placement.
b) Applicant shall provide evidence that it is formally certified and/or operates in accordance with a quality system complying with ISO 9001:2008 or equivalent. Applicant is to provide copies of applicable ISO 9001:2008 certificates or other quality management system certificates held.
Where applicant has no formal third party certification to ISO 9001:2008 (or equivalent) but operates to formal management systems, details of the systems being applied shall be provided for consideration.
c) Applicant shall provide a copy of their EH&S policy/statement
d) Applicant shall provide details of any reportable injuries, diseases and dangerous occurrences, etc (e.g. under RIDDOR or international equivalent) and environmental events/statistics.
e) Applicant shall provide details of any enforcements from statutory regulators (HSE/EA etc or international equivalent) to which the applicant has been subjected within the last 3 years. If applicant has had NO enforcements, state this fact clearly in the tender return.
