Description of the goods or services required

The City of Edinburgh Council (the “Council”), Forth Estuary Transport Authority, Lothian and Borders Police and Lothian and Borders Fire and Rescue Service (together the “Authorities”) are seeking a framework agreement with a number of firms to provide some of the legal services commonly required to be undertaken by the Authorities on an ad hoc basis. Expressions of interest from qualifying firms of solicitors (see 5.1 below) are sought. The procurement of these services shall be undertaken by the Council on behalf of the Authorities and all correspondence in relation to this procurement should be directed to the Council.

2.4

Total quantity or scope of tender

A number of framework agreements will be put in place covering the Authorities’ principal areas of business under 4 separate Lots. The procurement of these services shall be undertaken by the Council on behalf of the Authorities and all correspondence in relation to this procurement should be directed to the Council contact above (see 1.1).

Following evaluation of tenders for each lot, successful tenderers shall be appointed on the basis of a framework contract for a period of two years, with an option for the Authorities to extend for a further one year.

This project will be tendered under the following :

Lot 1 (Public Law, Corporate Law, Commercial Contracts; finance Law & Financial Services; Property Law; Intellectual Property; IT; Procurement, Competitions Law & State Aid; FOISA and Data Protection; Litigation and Pensions);

Lot 2 (Construction Law; Environmental Law; Planning Law and Transportation Law),;

Lot 3 (Childcare Law); and

Lot 4 (Employment Law).

Please note that the Council is under no obligation to accept either one or more Lots and there will be no right to recover costs or expenses incurred by Applicants in the preparation of their responses and for participation in any successive stages of this procurement, whether contracts are awarded or not.

Based upon historic expenditure, the estimated value of work to be awarded under all the framework contracts will be no greater than £4,000,000. Please note that the Authorities give no guarantee of any value or volumes of work which may be awarded under the framework contracts.

The Authorities propose to:

– shortlist up to 8 firms and appoint up to a maximum of 5 firms for Lots 1 & 2;

– shortlist up to 6 firms and appoint up to a maximum of 4 firms for Lots 3 & 4

but for each Lot retain the right to appoint more or fewer if they consider appropriate.

3 Conditions for Participation

3.1

Minimum standards and qualification required

Firms tendering for this contract must employ a minimum of 10 qualified solicitors and be indemnified by professional indemnity insurance for a minimum if £5,000,000 or such less amounts as the Authorities may stipulate.

All minimum qualifications and standards are to be included within the tender documentation.

Applications must be able to demonstrate sound financial standing and have substantial experience of providing services similar in size and complexity to those being sought.

Prospective organisations able to demonstrate relevant experience, resource and proven ability are invited to note their interest and register their company details at www.edin-tend.co.uk as soon as possible. After your organisation has noted interest in the contract the pre-qualification questionnaire shall be available for immediate download via the website www.edin-tend.co.uk. The Pre-Qualification Questionnaire must be submitted no later than 12.00 Noon on 31st August 2012.

The PQQ shall contain more detailed information about the Lots and the Authorities’ requirements. On the basis of the responses to the PQQ the Council shall then invite selected interested parties to tender for individual Lots or any combination of Lots. The services to be commissioned under the framework contracts are Part B Services contracts in terms of the Public Contracts (Scotland) Regulations 2012 (the “Regulations”) and will not be published in OJEU.

The award of call-off work under the framework contracts shall be awarded, at the Authorities’ discretion, on the basis of the tenderers’ original tender submission terms or be subject to further mini-competitions, as the Authorities direct or the circumstances require. Parties should note that call off work may involve the submission of a further detailed response to a request for quotation but may also necessitate (should the Authorities require it) attendance at an interview for such work.

This notice is published on a voluntary basis as the proposed contract is either fully, or partially, exempt from the requirements of the Regulations.
