II.1.5)Short description of the contract or purchase(s)
The contracting authority, acting on behalf of East London Solutions (ELS), is seeking expressions of interest with the intention of establishing a framework (or a number of frameworks) for the provision of Supplementary Passenger Transport by vehicles for Special Needs and other passengers with and without Passenger Assistants for itself and other member Councils of ELS. All vehicles are to be provided with drivers.
The framework will be accessible to the boroughs which constitute the East London Solutions group who have given a formal Expression of interest to be named in the development of this Framework, currently being the London Boroughs of Barking & Dagenham, Havering, Newham and Redbridge.
Barking & Dagenham and Newham have indicated their wish to participate (in whole or part of the framework agreement) at (or close to) the commencement of the framework.
Redbridge may access the framework at a later point as it will be open to members of ELS where a need is determined and contractors are appointed among those on the framework. Whilst the London Borough of Redbridge has expressed an interest in participating in the Framework, Redbridge reserves the right to review such participation. Should Redbridge decide to participate in the Framework at all such participation shall not commence until after September 2013 and even then the participation may not include the passenger assistant element of the Framework.The London Borough of Havering is unlikely to require services from the framework until its current arrangements expire in September 2013.
The lead authority on this procurement, the London Borough of Newham, and the members of ELS do not take responsibility for express or implied use of this framework by other ELS members. This form and the tender documents do not imply any commitment to appoint suppliers on the framework or any specified levels of future business.
The services described in this notice may also include additional services which are a repetition of the services provided under the original framework agreement in accordance with Regulation 14 (1)(d)(ii) of the Public Contracts Regulations 2006 (as amended).
The framework will be let in lots enabling the potential for provision of local services within each borough. The London Borough of Newham will enter into the Framework on behalf of the ELS boroughs. Call-off contracts will be entered into directly with each ELS borough who wishes to buy services.

III.1)Conditions relating to the contract

The performance of the contract is subject to particular conditions: yes
Description of particular conditions: Contractors must be fully compliant with the requirements of the Private Hire Vehicles [London] Act 1998, the Private Hire Vehicles [London] (Operators’ Licences) Regulations 2000 and any other Regulations applying when they come into effect.
Framework suppliers will be required to hold relevant licences for vehicles including those for either a Public Service Vehicle, a licensed Hackney Carriage or a licensed Private Hire Vehicle; the operator of the vehicles must also hold the appropriate licence.
All Drivers and operators of vehicles must be registered or licensed under the relevant authority including the Public Carriage Office, Transport for London Public Hire Vehicle Driver Licensing regulations and comply with the conditions there under including maintenance of satisfactory CRB clearance, satisfactory knowledge of the roads, satisfactory medical clearance and satisfactory MOT clearance (every 6 months’).
All vehicles used in the provision of the services specified within the Contract, other than a licensed taxi or PSV, must hold a valid London PHV Licence issued by the PCO and must display the official licence plates.
III.2)Conditions for participation
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established.
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.
All service providers must be fully compliant with regulations relating to the provision of passenger transport for hire and where appropriate must comply with the relevant statutory requirements at the time of hire.
