The work typically consists of general building / construction projects to carry out internal/external alterations and refurbishments on Staffordshire County Council owned properties with the occasional small extension. The majority of properties will include schools, libraries, community buildings and general offices.
Lot 2 — Mechanical
The works will typically consist of mechanical engineering items, either as standalone projects, or associated works in carrying out internal/external alterations and refurbishments on Staffordshire County Council owned properties with the occasional small extension. The majority of properties will include schools, libraries, community buildings and general offices. Works are likely to include, but not limited to, heating, domestic hot water and gas installations, also air conditioning and mechanical ventilation systems.
Lot 3 — Electrical
The works will typically consist of electrical engineering items, either as standalone projects, or associated works in carrying out internal/external alterations and refurbishments on Staffordshire County Council owned properties with the occasional small extension. The majority of properties will include schools, libraries, community buildings and general offices. Works are likely to include, but not limited to, electrical rewiring, installation of new power, lighting and control systems also electrical ventilation systems.

This procurement is for a framework agreement between the appointed economic operator(s) and Staffordshire County Council, to supply predominately works on a call-off basis, as and when required. With some services awarded on an ad-hoc basis.
The agreement value range of 48 million to 197 million GBP is over the total of 4 years for all lots inclusive. This is reflective of variations of budgetary provision and anticipated work from collaborative bodies. The lower end of the spend range is reflective of Staffordshire County Councils potential spend with the higher end incorporating other potential public sector partners both within and outside of the Staffordshire geographical border.
Lot 1 — Building — The value of each project will usually range between 5 000 GBP and 100 000 GBP with the occasional individual project reaching a value of 1 000 000 GBP

These organisations will be afforded third party rights or be named as beneficiaries under the contract or contracts where appropriate. It is envisaged that these organisations will be able to purchase services from the Strategic Partnership and/or the supply chain under the terms and conditions of the relevant contract, to be the subject of dialogue, or that they may participate in relevant vehicles set up as a result of this procurement process.

It is envisaged that 7 providers for the Building lot 1, 5 providers for the Mechanical lot 2 and 5 providers for the Electrical lot 3 will be awarded to the framework.

Information and formalities necessary for evaluating if the requirements are met: To carry out a financial review, Staffordshire County Council require a selection of financial documents (audited accounts etc), together with those of its immediate parent company where applicable, for scrutiny and to carry out pre-determined financial tests as detailed in the tender documentation.

1. It is the responsibility of the Provider to ensure that the appropriate accounts have been filed and that the credit information held is correct.
2. Should Providers wish other financial information to be taken into account to support the economic and financial check this should be submitted with the response to the PQQ.
Staffordshire County Council reserves the right to request further financial information and to take this into account where necessary in addition to the level of risk stipulated by the financial assessors.
3. For sole traders/partnerships where 3rd party financial assessments are not available the assessment will be undertaken using a financial spread sheet detailing trading account data for the last 3 years.
Financial checks will be undertaken for Providers using one or more of Staffordshire County Council’s current financial assessors n2check (www.n2check.com), Dunn and Bradstreet (www.dnb.co.uk) Experian (www.experian.co.uk). Providers will be assessed according to the level of risk stipulated by the financial assessors used.Refer to the PQQ documentation for all details of financial evaluation.
Minimum level(s) of standards possibly required: (1) A Provider’s submission may be rejected if a Provider is given an above average/higher than average risk rating or poorer, by one or more of the assessors named above.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum 10 calendar day standstill period (or 15 days where non-electronic or fax methods are used) at the point that an award decision notice is communicated to tenderers.
The award decision process will specify the criteria for the award of the contract/framework agreement, the reasons for the decision, including the characteristics and relative advantages, the name and score of the successful tender; and will specify when the standstill period is expected to end or the date before which the Contracting Authority will not conclude the contract/framework agreement.
If an appeal regarding the award of a contract/framework agreement has not been successfully resolved, the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
Any such action must be brought promptly (generally within 3 months). The Court may order the setting aside of the award decision or may order the Contracting Authority to amend any document and may award damages.
If an agreement has been entered into the Court may make a declaration of ineffectiveness or may order that the duration of any relevant specific contract be shortened and additionally may award damages.
The time limit for seeking such a declaration is generally 30 days from notification of the award (either by award decision notification or contract award notice depending upon the circumstances) or otherwise 6 months.
