The manufacture and supply of 10 off New Generation Nuclear Flask Carriers for operation on the UK rail network in accordance with the attached drawing and document pack.
Vehicles are to be certified/homologated in accordance with the Freight Wagon Technical Specification for Interoperability (T.S.I.)/UK Notified National Technical Rules (NNTR’s) for use on the UK Rail Network Infrastructure.
On completion, the vehicles are to be made available for collection by rail at a mainland UK location to be discussed and agreed.
The vehicles are required to enter service on a phased programme commencing December 2013 through to February 2014.

DRS are a wholly owned subsidiary of the NDA, providing rail transport services for spent nuclear fuel from power stations to Sellafield, DRS operate and maintain the existing fleet on behalf of the NDA supporting Magnox Ltd (effectively NDA) and EDF transport contracts. DRS have established relationships with these organisations to determine the design requirements and future demand.
DRS act as Design Authority and are the legally nominated entity responsible for the maintenance of the existing fleet under the Private Rail Wagon Agreement (PRWA). DRS are therefore acting as project manager for this particular tender, on behalf of the NDA. The ultimate contract will be placed between the successful contractor and the NDA.
The manufacture and supply of 10 off New Generation Nuclear Flask Carriers for operation on the UK rail network in accordance with the attached drawing and document pack.

Section III: Legal, economic, financial and technical information

III.1)Conditions relating to the contract
III.1.1)Deposits and guarantees required:
Insurance
i) The Supplier shall maintain in force the following insurances with a reputable insurance company:
a) for the duration of the Contract and for a period of six (6) years thereafter, public and products liability insurance with a limit of at least GBP 10,000,000 (ten million pounds sterling) per claim in respect of public liability and at least GBP 10,000,000 (ten million pounds sterling) in the aggregate in respect of products liability; and
b) “all risks” insurance covering physical loss of or damage in the joint names of Direct Rail Services and the Supplier for the full replacement value of the Rail Vehicles from the date that Direct Rail Services makes its first payment to the Supplier to the date that the Rail Vehicles are handed over to Direct Rail Services
(II) The public and products liability insurance is to incorporate an indemnity to principals clause providing that Direct Rail Services is indemnified by the Supplier’s insurers in respect of any claims brought against Direct Rail Services caused by the Supplier’s negligence or breach of statutory duty
(III) On NDA’s request the Supplier shall produce insurance certificates giving details of cover and the receipt for the current year’s premium in respect of each insurance.
(Iv) The Supplier’s liabilities under this Contract shall not be deemed to be released or limited by the Supplier taking out the insurance policies referred to in (I).
