Description of the goods or services required

In April 2013 the Supreme Court identified a defect in the Agricultural Holdings (Scotland) Act 2003 . In short, the defect prevented landlords from recovering vacant possession of their farms. A legal fix to the defect has now been passed by the Scottish Parliament which is the Agricultural Holdings (Scotland) Act 2003 Remedial Order 2014 (“Remedial Order”). It provides routes to landlords to recover vacant possession using section 73 of the 2003 Act which provides for various notice periods.

The legal defect affects people differently depending on their circumstances and a description of these groups is in the Plain English Guide which is annexed.

Scottish Government (SG) has acknowledged that harm has been caused. It has also offered to pay for and be part of mediation to enable tenants and landlords to explore best opportunities for reconciliation.

The purpose of mediation is to provide a forum to enable tenants and landlords to rebuild relationships where appropriate. The desire is that mediation will enable tenants, landlords and SG to explore possible options and to decide on their best course of action.

SG wishes to appoint a “mediation provider” to oversee and administer all mediation events in each matter referred to mediation and to provide suitably qualified mediators. This is to ensure consistency in overall administration, resources and delivery and the maintenance of high standards and overall quality.
