Justification for a framework agreement, the duration of which exceeds four years: This Framework can be used for projects up to GBP 1m in value (this is dependent on Hubco or NHS Framework Scotland 2 value restrictions) across the whole of the NHS Scotland estate and some projects may necessarily span a number of financial years. A duration of 6 years gives the Authority and the Framework Participants time to work together and achieve efficiencies across NHS Scotland and it provides a good background for enhanced community benefits.

II.1.5)Short description of the contract or purchase(s)

NP827/14 Medium Value Construction Projects will be a set of framework agreements across NHS Scotland in 34 geographic and value lots for minor building works. For the purpose of this procurement, Medium Construction Projects are defined as: Publicly funded projects with a value less than GBP 1m but greater than GBP 50k where a multi-discipline contractor is required to deliver new build or refurbishment projects including without limitation the construction of new health and social care centres along with other facilities, extension to existing buildings, the refurbishment/upgrading of existing premises and term contracts for specific programme of work. The scope does not generally include contracts over GBP 1m which should be delivered through Frameworks 2 managed by Health Facilities Scotland; it also excludes low value (under GBP 50k) small works and term trade contracts which will be managed at an individual Participating Authority level.
It is intended that the Participating Authorities shall be entitled to call off the Framework acting either individually or collectively.

The Contractor shall ensure that all contracts with Subcontractors and Suppliers which the Contractor intends to procure following the Commencement Date, and which the Contractor has not, before the date of this Contract, already planned to award to a particular Subcontractor or Supplier, are advertised through the Public Contracts Scotland procurement portal (www.publiccontractsscotland.gov.uk) and awarded following a fair, open, transparent and competitive process proportionate to the nature and value of the contract.

Under the terms of this contract the successful supplier(s) will be required to deliver Community Benefits in support of the authority’s economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations. The Community Benefits included in this contract are: to be described in the PQQ and also in the ITT for this project. Community benefits may be assessed as part of the evaluation process for appointment to the framework agreement and, separately, for each specific contract executed under the framework agreement. Successful economic operators will be required to work with the Authority and Participating Authorities to agree community benefits for both the framework agreement and the specific contracts and to monitor and measure the benefits for reporting purposes.

Precise information on deadline(s) for lodging appeals: The Authority will notify economic operators who submitted a tender or (where no deselection notification has previously been made) applied to be selected to tender, of its decision to award the framework agreement which notification will contain among other information, a summary of the reasons why the economic operator was unsuccessful. The notification will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the Authority despatches the notice(s) and the date on which the Authority proposes to conclude the relevant framework agreement. The bringing of court proceedings against the Authority during the standstill period will automatically continue the prohibition on entering into the framework agreement until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the framework agreement has been entered into include the setting aside of the decision to award the framework agreement to the winning tenderer(s). The bringing of court proceedings against the Authority after the framework agreement has been entered into will not affect the framework agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2012 can be established. Otherwise the remedies that may be awarded by the courts where the framework agreement has been entered into are limited to the award of damages. Economic operators are entitled to write to the Authority after receipt of the notification should they require further clarification. The Authority will respond within 15 days of such a written request, but it should be noted that receipt by the Authority of such request during the standstill period may not prevent the Authority from awarding the framework agreement following the expiry of the standstill period. Where an economic operator is dissatisfied with the Authority’s response to its request for clarification, or considers that the framework agreement has been concluded in breach of The Public Contracts (Scotland) Regulations 2012, such economic operator is advised to promptly seek independent legal advice.
