Our aim is to establish a highly competitive legal services framework agreement for Member Institutions across the five participating consortia. While the contracting authority cannot guarantee volumes, it is estimated that higher education institutions in England currently spend circa 70 000 000 GBP per annum on legal services.

This is an estimation based on historical spend in this service area. It may vary considerably up or down. No business whatsoever is guaranteed under any resulting framework agreement or contract and there is no guarantee that any framework agreement or contract will be put in place in relation to this notice or that there is an exclusivity in any way in respect of the relevant services. No compensation etc will be paid if a tender or resulting framework agreement is withdrawn for any reason. Providers should take part in the process only on the basis that they fully understand and accept this position.

LUPC, acting as the Consortium, is working with the English and Welsh higher education sector procurement consortia (North Eastern Universities Purchasing Consortium, North Western Universities Purchasing Consortium, Southern Universities Purchasing Consortium and Higher Education Purchasing Consortium Wales) to establish a Framework Agreement for the Provision of Legal Services at national level. This tender has the support of British Universities Finance Directors Group (BUFDG), Association of University Legal Practitioners (AULP), Universities HR and Association of University Directors of Estates (AUDE).

Please note that all the Member Institutions of all the Consortia will have access to this Framework Agreement. NWUPC currently has two Member Institutions based in Northern Ireland. These Member Institutions based in Northern Ireland may utilise the Framework for generic legal services and have different arrangements for jurisdiction specialist work.

The Authority expressly reserves the right to not award any Framework Agreement as a result of the procurement process commenced by publication of this notice, and to make whatever changes it may see fit to the content and structure of the tender. In no circumstances will the Authority be liable for any costs incurred by the Potential Provider.

Orders placed under this Framework Agreement will form a separate legal services contract under the scope of this Framework Agreement between the Provider and the Member Institution. Orders may be placed via direct award, desktop exercise or further competition. The further competition option allows for dual award. Additional information on call-off procedures can be found in the tender documentation.

The Authority and Framework Agreement users reserve the right to use any electronic portal during the life of the Framework Agreement.

Electronic ordering and/or electronic invoicing and/or electronic payment may be used during the period of the Framework Agreement and throughout the duration of any call-off arrangement.

This Framework Agreement will be for an initial period of three (3) years, with the option to extend for one period of twelve (12) consecutive months.

Potential Providers may express interest in as few or as many lots as they wish. A shortlist of up to 56 suitable Providers will be established at SQ stage and these will be invited to submit detailed tender proposals. A maximum of eight (8) suppliers will be awarded to each specialist lot (lots 1 to 6) and a maximum of ten (10) suppliers will be awarded to the one-stop-shop lot (lot 7). The mechanisms for shortlisting and award, at SQ and ITT stages respectively, is detailed in the tender documentation. The ITT stage Quality Evaluation is weighted 60 % and the Price Evaluation is weighted 40 %. Under Article 46 (4) of the Public Contract Regulations 2015, each Provider will be awarded no more than three lots. This is in order to provide opportunities for a wider variety of Providers to be appointed to the Framework Agreement and improve opportunities for award to SME’s.
