This framework provides a range of services, from which individual patients, social care clients and health and care professionals can choose to commission bespoke transport solutions for their health or social care transport needs. This framework can accommodate patient /client and non patient movements around the health economy as well as extra contractual journeys going further afield. Through a competitive procurement process the aim is to increase the extent to which a broad base of providers are able to participate in the health and social care transport market, through a governed framework and demonstrate value for money.

II.2.1)Total quantity or scope:

This is a framework agreement process similar to the open procedure recognised under EU Procurement Directives, whereby any Provider can apply to be on the framework agreement and all who meet the criteria will be awarded a place on the framework agreement.
Additionally, an opportunity to apply for the framework agreement will be made at 6 monthly intervals to maximise competition and equal opportunity for providers.
This Framework Agreement will provide but not limited to the contracting bodies identified at VI.3 (and any future successor to these organisations) and associated bodies with a range of Health and Social Care Transport, including but not limited to Urgent Care, Mental Health, Learning Disability, End of Life Care, Acute Hospitals, General Practice, Clinical Commissioning Groups, Community Service Providers, Primary Care, Personalised Packages of Transport for Personal Budget Holders, Community Logistics and any other future transport requirements within the Health and Social Care sector.
It offers no guaranteed level of activity or payment to any successful Providers. The service will be procured against a common service specification split into 30 lots, consisting of geographical areas. All Providers who wish to provide the services are invited to apply and must be able to demonstrate compliance with the evaluation criteria.
For Providers who fail to meet the criteria the first time of applying or for any new entrants to the market during the life of the Framework, the application process will be re-opened as a minimum at 6 monthly intervals and advertised accordingly.

The duration referenced in Section II 1.4) is for the placing of orders. The value provided in Section II 1.4) is only an estimate.
The overarching agreement is for 5 years and will end in October 2020 unless the 2 year extension is put into place.
As per clause 2.1 of Document 1 The Applicant Instructions we are re-opening the competition to the market to allow new entrants. We cannot guarantee to successful Providers any business through this Framework Agreement. Spend and volumes may vary throughout the life of the Framework Agreement from the indicative levels given in this notice.
Participants are advised that this is a voluntary OJEU notice but is nevertheless subject to the general objectives of transparency; equal treatment and non-discrimination.
NHS SBS reserves the right for an electronic auction to be held by the public sector bodies during further competition among the parties to the framework.
NHS SBS expressly reserves the right (i) not to award any contract as a result of the procurement process commenced by publication of this notice; and (ii) to make whatever changes it may see fit to the content and structure of the tendering competition; and in no circumstances will NHS SBS be liable for any costs incurred by the candidates. If NHS SBS decides to enter into a Framework Agreement with the Providers, this does not mean that there is any guarantee of subsequent contracts being awarded. Any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of potential Providers. Any orders placed under the Framework Agreement will form a separate contract under the scope of this Framework between the Provider and the specific requesting other contracting body.
NHS SBS and other contracting bodies utilising the Framework reserve the right to use any electronic portal during the life of the agreement. NHS SBS is working in partnership with 365 Response Limited (365) to establish a National Transport Framework for Care, Healthcare Logistics and Call Handling Services for access by all of its customer member organisations. The framework can be used by including without limitation, the following UK, Isle of Man and Scottish bodies (and any future successors to these organisations); Public sector bodies, including any statutory and other successor organisations to any of the foregoing and in addition any other commissioners (whether alone or jointly with any other organisation), Providers and regulators of NHS Funded (either in whole or in part) Services including Clinical Commissioning Groups, NHS England (and all sub national offices including any body).

This period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into.
If an appeal regarding the award of a contract has not been successfully resolved aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly.
