Sunderland City Council acting on behalf of the North East Procurement Organisation (NEPO) are looking to put in place a framework for the Provision of Civil Engineering and Infrastructure Works for a period of 4 years. The framework will be divided into 15 Lots based on type of work and value. The types of works are:
— Infrastructure Projects;
— Highways;
— Marine, Coastal;
— Highways structures;
— Drainage;
— Public Realms.
The tender will be conducted via the online NEPO portal.

Information and formalities necessary for evaluating if the requirements are met: Applicants’ economic and financial ability shall be assessed in accordance with Regulation 58 of the Public Contract Regulations 2015.

Information and formalities necessary for evaluating if the requirements are met:
Applicants’ technical capacity to deliver the contract shall be assessed in accordance with Regulation 58 of the Public Contract Regulations 2015.
Information and formalities etc.:
Applicants must supply a list of all relevant principal contracts (as defined in the BQ) performed in the previous 5 years.
Applicants must also provide Performance Certificates in accordance with the requirements set out in the BQ for each relevant principal contract which confirms in each case whether or not the contract has been, or is being, satisfactorily performed in accordance with its terms.
Where an Applicant proposes to rely on other entities (including sub-contractors or consortium members) to perform the contract, the Applicant must describe the function that each such entity will perform under the contract and also provide the information required above in relation to each entity too.
Minimum level(s) of standards required:
Any Applicant must meet the selection criterion in relation to reliability based on past performance as specified in the BQ.
Where the Applicant proposes to rely on other entities (including sub-contractors or consortium members) to perform the contract, then the selection criteria for reliability must also be met by each entity.
The Authority will assess whether or not the criterion is satisfied at selection stage and reserves the right to re-assess it is satisfied at any time during the procurement process (including without limitation prior to contract award).

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the (contract)(framework agreement) is communicated to tenderers to provide time for unsuccessful tenderers to challenge the award decision before the (contract) (framework agreement) is entered into. Unsuccessful tenders shall be notified by the contracting authority as soon as possible after the decision is made as to the reasons why they were unsuccessful. Where the tenderer considers that the contracting authority has acted in breach of the Public Contracts Regulations 2015 (‘the Regulations’) and that, as a result, the tenderer has suffered, or risks suffering, loss or damage, the tenderer may bring proceedings against the contracting authority under the Regulations. Proceedings must be brought in the High Court and are subject to time limits: within 30 days of the date upon which the tenderer knew, or ought reasonably to have become aware, of the grounds for challenge.
