The provision of passenger transport services for children/young people with Special Educational Needs/Disabilities and vulnerable adults. The services provided by the framework will also include for the provision of transport for ad hoc journeys by staff on Council business.
It is envisaged that the framework of providers will be available for use by other public sector bodies including Croydon schools with minimum involvement from the Council. Future provision of the framework may include:
School/college trips as requested and paid for by Croydon schools/colleges, Council clients requiring non-emergency ambulance and/or nursing escort services (other than where this is the responsibility of the NHS), and direct call-off by clients with personal budgets/direct payments to meet educational or social care needs.

II.2.1)Total quantity or scope:

The London Borough of Croydon is seeking tenders from companies that wish to be included in a Framework Agreement for the provision of passenger transport services from July 2015 primarily for vulnerable children, young people and adults.
The framework will also include for the provision of ad-hoc passenger journeys to satisfy the requirements of the Council.
The vehicles required will include cars, estate cars, multi-purpose vehicles, minibuses and coaches, including specially-adapted vehicles for the carriage of wheelchairs. Journeys may be required on a regular or ad hoc basis and are mostly within the Borough of Croydon and the surrounding areas, but some longer distance journeys will be required. The services required may include the provision of passenger assistants.
Tenderers will not have to provide all categories of vehicles and/or passenger assistants to be considered for inclusion in the Framework Agreement.
Currently, the Council provides transport for some 1 100 clients on 376 routes to 123 destinations. There are currently 16 destinations (mostly in-Borough special schools) served by minibus/coach services operating some 70 daily routes and carrying c600 passengers, Additionally, all 123 destinations (a mix of in-borough and out-of-borough) are served by car/mpv services operating 306 daily routes and carrying c500 passengers, again generally on a daily basis but with a small number of weekly/termly journeys.

Description of particular conditions: All service providers will be required to participate actively in the achievement of social and environmental policy objectives. Accordingly contract performance conditions may relate in particular to social and environmental considerations. Vehicles used by the organisation must have the appropriate licence to operate. All drivers and escorts employed on this work must be suitably qualified and licenced. Organisations must undertake enhanced Disclosure and Barring Service checks on those employees engaged in, and those potential employees which might be engaged in, the provision of the services.

The Council believes that the requirements of the Transfer of Undertakings (Protection of Employment) Regulations 2006 will apply to a number of Contracts called off from the framework.
The Council reserves the right, subject to the provisions of the Public Contracts Regulations 2006 (as amended by the Public Contracts (Amendment) Regulations 2009 and the Public Procurement (Miscellaneous Amendments) Regulations 2011) and other appropriate rules governing public procurement, to change without notice the basis of, or the procedures for, the competitive tendering process or to terminate the process at any time prior to award of contract. The Council do not bind themselves to accept the lowest tender, or any tender received, and reserves the right to award the contract in part, or to call for new tenders should they consider this necessary. The Council shall not be liable for any costs or expenses incurred by any tenderer in connection with the completion and return of the information requested in this Contract Notice, or in the completion or submission of any tender.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006 (as amended) the Council will incorporate a minimum 10 calendar day standstill period at the point information on the framework agreement award decision is communicated to tenderers. Part 9 of the Public Contracts Regulations 2006 (as amended) provides for economic operators who have been harmed or are at risk of harm by breach of the Regulations to take legal action. Any such action must be brought within the applicable limitation period. The purpose of the standstill period referred to above is to allow an economic operator to apply to the Court to set aside the award decision before the framework agreement is entered into.
