The contracting authority is faced with circumstances of urgency which render impracticable the time limit laid down in relation to an open procedure by Regulation 27(2) of the Public Contracts Regulations 2015, and which would ordinarily apply to such a procedure. In brief, the circumstances are that [the College is required to have in place the infrastructure to which this procurement relates by no later than 4.12.2015 in order to be in a position to meet essential operational deadlines to which the College is likely to be subject at any time thereafter, and which it would not be in a position to meet unless this procurement has been concluded beforehand. The College has only recently been made aware that it would be unable to meet the deadlines referred to above unless it has done so, and is not therefore in a position to observe the time limits ordinarily applicable to the open procedure. The College is looking to secure a contract arrangement with a provider for a Data Centre.

1. The objective of this Tender is to identify the most economically advantageous offer. The criteria by which this Tender will be evaluated is detailed within this document.
All enquiries relating to this Tender must be forwarded in writing via In-Tend Electronic Tendering System Correspondence.
2. This Contract Agreement is intended to commence on 8.12.2015 will be awarded for a fixed period to be agreed with The Manchester College, subject to satisfactory performance and the agreement of both parties. Regular reviews of the agreement will take place.
3. This Contract Agreement is intended to commence on 8.12.2015 will be awarded for an initial period of 3 years. Consideration will be given to extending the Agreement for a further 1 years, subject to satisfactory performance and the agreement of both parties. Regular reviews of the agreement will take place.
4. The return Tender should contain all the original parts of the Tender together with all the items indicated in the ‘List of Documents To Be Completed’. The Tender Documents must not be altered by the Tenderer in any way. Any modification considered necessary by the Tenderer should be detailed in a separate letter accompanying the Tender. Tenders may not be considered if the complete information requested is not provided at the time of tendering. The Tenderer should quote their name and the Tender reference number on any supporting papers submitted with the Tender.

Tenders must reach us via the In-Tend Electronic Tendering System by 12.00 pm 26.11.2015. Late tender bids will not be considered. Failure to use the Tender documents will invalidate the Tender. We reserve the right, both prior to and after the award of the Tender, to inspect the validity of all information given, in order to substantiate the figures detailed by a tenderer.

Precise information on deadline(s) for lodging appeals: Precise information on deadline(s) for lodging appeals: The Manchester College will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. In the first instance such additional information should be requested from the address provided in part I.1. Following that if the parties still cannot resolve the matter then it should be escalated to the Company Secretary, The Manchester College, Ashton Old Road, Openshaw, Manchester, M11 2WH. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
