Provision of Legal Services to Scottish Natural Heritage

2.2

Description of the goods or services required

Scottish Natural Heritage (SNH) is a Non-Departmental Public Body (NDPB). Its statutory duties are to secure the conservation and enhancement of the natural heritage of Scotland, and to help people to understand, enjoy and use it wisely so that it can be sustained for future generations.

The intention is to appoint a law firm to provide dedicated and accessible legal services and advice to Board and staff as required. The successful firm should ideally be experienced in the following areas:

– The corporate governance, duties and responsibilities of public sector agencies, in particular NDPBs and Local Authorities;

– Scottish, UK & EU Natural Heritage and Countryside Legislation, and relevant case law and its interpretation;

– Scottish, UK and EU environmental and other relevant case law and its interpretation;

– Provision of advice on interpretation of new environmental and other relevant legislation;

– Scottish Planning law;

– Planning Appeals, Inquiries and Hearings;

– Scottish Outdoor Access Law;

– Land Management Agreements.

The contract will initially be for the period 2 July 2015 to 1 July 2016, with the expectation that, subject to satisfactory performance and continued need, it will be extended annually for up to four further years (i.e. to 1 July 2020).

To be considered for this contract opportunity, firms must note their interest on the Public Contracts Scotland (PCS) portal – www.publiccontractsscotland.gov.uk – and submit a completed Pre-Qualification Questionnaire (PQQ) to contract.advertising@snh.gov.uk by the stated deadline of 13:00 hours (1pm) on Monday, 16 March 2015.

All PQQs will be assessed, and short-listed firms will be invited to submit a competitive tender via the PCS portal. Firms who submit a PQQ but are not short-listed to ITT stage will be notified by email.

Please note that one or more firms may be invited to interview/presentation as part of this procurement process, and that costs related to this will be borne by the firm(s) attending.
