No special legal form is required but if a contract is awarded to a consortium, the Contracting Authority may require the consortium to form a legal entity before entering into the Framework Agreement. Where a Consortium bid is proposed, any consortium to have a designated lead service provider, all members will have joint and several liability in respect of the obligations and liabilities to the framework agreement and any subsequent contracts.

Description of particular conditions: The Model Form of Contracts to be used under the agreement will be the NEC 3 Professional Services suite of Contracts.

The successful Economic Operators will be required to comply with the security standards set by the Office for Civil and Nuclear Security (OCNS).

VI.4.1)Body responsible for appeal procedures

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: Magnox Ltd will incorporate a standstill period, of 10 calendar days following the notification of an award decision. Potential Providers who are unsuccessful shall be informed by the Authority as soon as possible after the decision has been made as to the reasons why the Potential Provider was unsuccessful. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the framework agreement is entered into.
If an appeal regarding the award of the framework agreement has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period.
Where a framework agreement has not been entered into, the Court may order the setting aside of the award decision or order Magnox to amend any document and may award damages.
If the framework agreement has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order Magnox Ltd to pay a fine, and/or order that the duration of the framework agreement be shortened.
