Ipswich Borough Council is inviting tenders for the receipt and treatment of garden waste only. The delivery point for the receipt of material could either be a direct treatment facility or a Waste Transfer Station within 10 miles of IP1 1AA. The scope of this procurement is anticipated to be for approximately 8 900 tonnes per annum, the amount will be variable over the period of the contract and this tonnage not being warranted or guaranteed. It should be noted that Ipswich Borough Council is, via a separate procurement inviting tenders for services for the provision treatment of Garden Waste and uncooked (vegetable kitchen) waste. The treatment of the Organic Waste will produce a compost material to accepted industry standards. For the avoidance of doubt the processed material must be classifies as recycled in accordance with National Indicator 192 ( or any future amendment to this standard.

The provision to provide a facility for the delivery and treatment of garden waste only as mentioned in II.1.5 above for a period of three years with the possibility of a 2 year extension which may be as a 12+12 month or any number of extension that do not exceed 24 months in total.

Description of particular conditions: The contract may be subject to Transfer of Undertakings (Protection of Employment) Regulations (TUPE).
The Contractor shall:
(a) be a ‘fit and proper person’ in accordance with the requirements of section 74 of the EPA, having technical competence within the meaning of the Waste Management Licensing (Amendment) (England) Regulations 2003; and
(b) comply fully with the terms of any Site Licence, PPC Permit if required and planning permission relating to the Site, the EPA, the Pollution Prevention and Control Act 1999 and the Pollution Prevention and Control Regulations 2000 (as amended) and any separate licences or approvals pursuant to Regulations;
(c) comply with the Environmental Permitting (England and Wales) Regulations 2010.

The time limit stated in IV.3.3 is for requesting the Invitation to Tender (ITT). Requests to participate may only be made by obtaining and completing the ITT and returning it, with other documents requested in it, to the Council stated in I.1 by 12 noon on Monday 4.1.2016. Details for the return of tenders are as stated in the ITT.
All dates and time periods specified in this notice are provisional and the Contracting Authority reserves the right to change them.
The Authority reserves the right not to award the two parallel contracts.
On behalf of the Suffolk Waste Partnership, Suffolk County Council are tendering Lot 5 on behalf of Ipswich Borough Council. The Authority will only be awarding a contract for one of these three tenders.
It reserves the right not to proceed with all or any part of the project detailed in II.2 above and in no circumstances will it be responsible for any costs incurred by economic operators as a result for the publication of this notice or otherwise in connection with their tenders.

Precise information on deadline(s) for lodging appeals: The authority will allow a standstill period of at least 10 days at the point information on the award of the contract is communicated to tenderers. The standstill period provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 provide for an economic operator who has suffered or risks suffering loss or damage by a breach of the regulations to take proceedings in the High Court. Proceedings must normally be started within 30 days of the date when the economic operator first knew or ought to have known that grounds for starting proceedings had arisen.
