The MoJ Commercial and Contract Management Directorate, as the contracting authority on behalf of the Secretary of State for Justice, will work closely with the National Offender Management Service Co-Financing Organisation (NOMS CFO) who are the commissioning body for NOMS European Social Fund (ESF) provision, in respect of this procurement (together, ‘the Authority’).
NOMS was granted national CFO status by the ESF in 2009 and retains this status under the 2014-2020 ESF Operational Programme. It is under this Programme that the funds referred to in this contract notice have been allocated. The total level of funds allocated to NOMS CFO for the purpose of contracting for the delivery of services is GBP 115 28 ,000.
The focus of NOMS CFO is to help offenders move towards mainstream provision or into employment by addressing their barriers to work through facilitating access to comprehensive support mechanisms appropriate to their individual circumstance and assessed need.
Under this contract notice the Authority is seeking potential providers to assist with providing these comprehensive support mechanisms in each of the nine ESF Contract Areas (‘ECAs’) identified below. This may entail provision of educational, training, vocational, counselling and rehabilitation services. These services will be provided to eligible offenders who are in custody or in the community (known as ‘participants’). There will be an emphasis on providing these services to those participants furthest away from mainstream activity, with an additional focus on a number of specific hard-to-reach groups within each of the nine ECAs.
These services will be delivered on a case management basis, developing a programme for each participant. It is expected that in up to 70% of cases these services will first be provided to participants when they are in custody. However, as participants progress through the case management programme it is expected that the split will become 50:50 between custody and community.
The Authority intends to award one contract for each of the nine ECAs identified below. For the purposes of this procurement, each ECA represents a lot. The nine lots and their values are given below:

Bidders may apply for 1, several or all lots. However, bidders are only entitled to win up to 35 % of the contracts (by value) covered by this contract notice as a result of this competition.
Further information about these lots can be found in the ‘information about lots’ section of this contract notice. The value of each lot and the total value of these purchases (in II.1.4) represent the current level of funding that NOMS CFO has obtained from the ESF 2014-2020 Operational Programme for the purpose of contracting for the delivery of services. This is subject to final European Commission approval which is expected later this year, ahead of contract award. If additional funding is received after the publication of this contract notice then the total value of the lots may increase above GBP 115,280,000. The value of any potential additional funding is currently unknown but could be in the region of up to GBP 115,280,000. The Authority reserves the right to adjust the contract values in the event that additional funding is obtained whether at, above or below the potential additional funding level indicated above. If additional funding is obtained it is expected that the Authority will distribute this money among the nine lots on a pro rata basis.
Contracts are expected to commence on or around April 2015 and to run until December 2020, reflecting the end of the ESF 2014-2020 Operational Programme. In addition, the contract for each ECA will include an extension option which may be exercised at the Authority’s discretion. The total period for the extension could be a maximum of two years. The extension period will most likely be divided into two 1 year extensions.
The contract for each lot will also include a break clause which may be exercised by the Authority as of 31 December 2017. The Authority will determine whether to exercise the break clause on a contract by contract basis. The circumstances in which the Authority may exercise the break clause may include for example if it is subsequently discovered that there is an overlap between the services provided pursuant to this tender process and those performed under the complementary Transforming Rehabilitation (‘TR’) Programme.

The Authority is also not obliged to follow any of the specific procedures provided for in the Public Contracts Regulations 2006 (as amended). Although the Authority intends to run a process similar to the open procedure, this is done on a voluntary basis and the Authority reserves the right at any time to depart from this procedure.
The Authority reserves the right to vary the tender process or to cancel it at any time. If a contract is terminated early due to the fault of a supplier, the Authority reserves the right to allow another provider in a different ECA to temporarily take over the obligations of the exiting provider to ensure that the services are continued until a new tender process can be completed.
