This Framework is for Removal, Relocation and Warehouse Storage Services.
The Framework will be a multi-supplier ranked framework and will be divided into the 2 lots as follows:
— Lot 1 — Removal, Relocation and Warehouse Storage Services for adhoc removal requirements. This lot shall include for example office moves, other Council premises moves, school decants and the decant of Council tenants and any other removals (excluding Homeless Services) — ITT 5821;
— Lot 2 — Removal, Relocation and Warehouse Storage Services for the Council’s Homeless Services — ITT 5822.
The Framework may be utilised by all departments of Renfrewshire Council. Renfrewshire Leisure Ltd who are a Partner organisation of Renfrewshire Council may utilise Lot 1 — Adhoc Removals — ITT5821.

Tenderers should note there can be no guarantee of any level of business for a tenderer being appointed onto the framework.

Lot 2 — Removal, Relocation and Warehouse Storage Services for Homeless Persons. The Council has a statutory duty to provide removal and storage facilities for persons who find themselves homeless and are being assisted by the Council’s Housing Advice and Homeless Services.

All pricing in the tender submission must be in sterling (GBP). Payments will be made to a Service Provider in sterling (GBP)as detailed in the tender documentation.

III.1.3)Legal form to be taken by the group of economic operators to whom the contract is to be awarded:

None preferred, however for entering into and performing the contract, Tenderers will require to form a legal entity recognised by Scots law. There is no preferred form of economic operator but each individual in any group is to be jointly and severally liable for the contract. In the event of an associated group of companies being successful, the Council will require each company to be jointly and severally liable for the satisfactory performance of the contract. This assurance will be required in writing before any contract can be awarded to such a group.
Tenderers will be required to confirm that none of the factors listed in Article 47 of Directive 2004/18/EC and Regulation 23 of the Public Contract (Scotland) Regulations 2012 (as amended) are applicable to their organisation.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.
Service Providers must be a registered member of the British Association of Removers (BAR) or an equivalent body which is acceptable to the Council, and must adhere to their code of practice.
Other conditions will be stipulated in the tender document.

III.2.2)Economic and financial ability

Minimum level(s) of standards possibly required: The Council will use Dun and Bradstreet (D&B) to assist in its determination of the organisations financial status and risk where the contract is over 100 000 GBP or where tenderers have aggregated spend over multiple contracts with the Council over 100 000 GBP. Tenderers must achieve as a minimum a D&B failure score of 20 or above. It is recommended that tenderers review their own D&B Failure Score in advance of submitting their tender submission. If, following this review, Tenderers consider that the D&B Failure Score does not reflect their current financial status the Tenderer will be required to provide a detailed explanation, together with any relevant supporting independent evidence. The Council will review any such information as part of the evaluation of the Tenderer’s financial status. Where a consortium bid is received, the D&B Failure Score of each consortium member shall be assessed. Where the Tenderer is a subsidiary of a group but is applying as a separate legal entity and fails to meet the minimum financial turnover requirements or minimum D&B Failure Score (or equivalent) as a company, in order to progress to stage two of the evaluation they must provide as part of their tender submission, written confirmation from an authorised signatory of the parent company, that either a parent company or bank guarantee will be provided within two weeks of request. The parent company must meet the minimum financial requirements as assessed by the Council. The parent company or bank guarantee will be in the form provided in the Tender Documentation.
Tenderers will be required to provide 1 of the following:
a. A copy of your audited accounts or equivalent for the most recent 2 years, along with details of any significant changes since the last year end or
b. A statement of your organisation’s turnover; profit and cash flow for the most recent full year of trading or where a full year trading has not been completed the same information for the period applicable. Note if this information is not available in an audited format tenderers will be required to provide an end of period balance sheet or make the response specified in option (c) below or
c. If you a tenderer is unable to provide the information requested above, the tenderer will be required to provide additional information and documentation that will give the Authority the assurance that you are capable of carrying out any subsequent awarded contract. For example, a statement of your organisation’s cash flow forecast for the current year and a letter from your bank outlining the current cash and credit position or other alternative means of demonstrating financial standing.
d. Tenderers bidding for ITT 5821 — lot 1 — Adhoc Removals must have a minimum turnover of 200 000 GBP per annum.
e. Tenderers bidding for ITT 5822 — lot 2 — Homeless Services Removals must have a minimum turnover of 100 000 GBP per annum.
f. If a Tenderer is bidding for both Lot 1 and Lot 2 they must have an annual turnover greater than 300 000 GBP.

(1) All candidates will be required to provide certification from an independent body attesting conformity to environmental management standards in accordance with the Community Eco-Management and Audit Scheme (EMAS); or the European standard BS EN ISO 14001.

(3) A statement of the tools, plant or technical equipment available to the service provider or contractor for carrying out the contract.
