Tower Hamlets Council (the Council) is seeking tenders for training and consultancy support in 2 specialist areas of work for the benefit of Tower Hamlets businesses. These 2 areas of work are:
— Support for increasing the marketing capacity of retail businesses; and
— Support for businesses in any sector to be able to supply goods and services through contracts which have been the subject of a procurement exercise.
What activity in these 2 areas of work has in common is that success on the part of the businesses supported will increase turnover. This in turn will tend to improve business prospects and lead to beneficial effects generally in the local economy.
These 2 areas of work are however the subject of 2 separate initiatives run by Tower Hamlets Council: respectively the ‘Retail Marketing’ Initiative and the ‘Supply Tower Hamlets’ initiative.
Looking at support for retail marketing in isolation, there are 2 aspects to the support work required, as follows:
— Consultancy support for retail business marketing; and
— Provision of an online platform to support the marketing activities of retailers which receive consultancy support.
There are therefore 3 areas of work, each of which is the subject of a different lot, as follows:
— Lot 1 — Provision of Retail Marketing Consultancy Support (part of the Retail Marketing initiative);
— Lot 2 — Provision of Retailers Online Marketing Platform (part of the Retail Marketing initiative);
— Lot 3 — Provision of Tendering Support (the Supply Tower Hamlets initiative).

Lot 1:
The Lot 1 project is for the delivery of consultancy support to retailers, to enable them to market their goods and services more effectively, making them more robust and sustainable and enhance their opportunity to increase turnover in the long term.
The budget available for Lot 1 is 311 000 GBP and will not exceed this amount during the period over which Retail Marketing Support is running.
This budget will be for the provision of marketing consultancy support to not fewer than 240 retailers whose businesses are located in the London Borough of Tower Hamlets. The definition of ‘retailer’ extends to any business selling goods or services to individuals in the course of trade, rather than business to business activity. A retailer in this sense can therefore include a street trader, a shop proprietor and a person selling goods and services online.
The successful economic operator(s) awarded to this Lot 1 will:
— Identify and recruit retailers to participate as project beneficiaries;
— Arrange for a diagnostic service for each participant retailer — taking into account the size of the business, the goods/services it offers, its location and its existing marketing capacity — to develop a marketing development plan;
— Deliver a range of support services to retailers, including seminars and 1-to-1 consultancy support, to enhance the marketing capacity of the participant retailers on (inter alia) the following skills and abilities;
— Analysing local consumer market opportunities;
— Developing marketing techniques in niche products/markets;
— Developing online/ social media marketing;
— Putting in place effective visual merchandising;
— Identifying other sources of suitable marketing/retail/business support.
Lot 2:

Lot 2 is intended to facilitate the development, design, hosting and content management of an online marketing platform (website) for retailers (shops, street market traders and online traders) in Tower Hamlets (the Lot 2 project). The objective of the Lot 2 project is to enable local retailers who are beneficiaries of the Lot 1 project to have the opportunity of developing their online presence and hence their capacity to generate increased income. A presence on the website is intended to be a 1st step for retailers in online marketing, and the Lot 2 project is a means by which retailers who take part in the Lot 1 Retail Marketing Consultancy Project can find a practical way of developing an increased marketing capacity.

The budget available for Lot 2 is 48 950 GBP and will not exceed this amount during the period of this contract term. It The Lot 2 provider will develop, design, host and manage (or facilitate content) of an online marketing platform (website) for retailers (shops, street market traders and online traders) located in Tower Hamlets — primarily for retailer participants in the Lot 1 Retail Marketing Consultancy Project.
The Lot 2 provider will develop, design, host and manage (or facilitate content) of an online marketing platform (website) for retailers (shops, street market traders and online traders) located in Tower Hamlets — primarily for retailer participants in the Lot 1 Retail Marketing Consultancy Project. The service will include (but not limited to) the following:
— Consultation with retailers (shops, street market traders and online traders);
— Arranging design workshops and/or webinars with interested retailers;
— Establishing and maintaining a retailers working group to assist in the design and content of the website;
— Following approval by the Council of the design and content proposals, developing and launching a website (mobile enabled) for retailers;
— Providing basic training to retailers on uploading content to their own space on the website;
— Monitoring website usage and reporting to the Council information on traffic/visitors to the website development of a sustainable plan for the maintenance of the retailers’ website post completion of the project.
It is not intended that the online marketing platform should constitute a form of e-commerce facility.
Lot 3:
The aim of the Lot 3 project is to create opportunities for SMEs in all sectors in Tower Hamlets to develop their knowledge, expertise and confidence in making bids for new contracts presented through formal procurement routes by the private and public sectors.
This lot comprises initiatives to create opportunities for all SMEs in Tower Hamlets to develop their knowledge, expertise and confidence in making bids for new contracts presented through formal procurement routes by private and public sector organisations. The budget available for Lot 3 is 1 030 000 GBP and will not exceed this amount during the period over which the project is running.
The Lot 3 project will engage and register a substantial number of the borough’s SMEs and support many of them in achieving fit to supply capability. Through support given, the Lot 3 project will bring about a substantial number of contracts won by these registered enterprises registered (or ‘client enterprises’).
Fundamental to the Lot 3 project is the concept of ‘fit to supply capability’. This concept is important, as an SME which achieves this capability will be able to bid successfully for contracts through procurement processes indefinitely into the future. An individual business will have achieved this capability if it:
— Has a good knowledge of the potential demand for its goods and services by larger organisations and an appreciation of its capacity to deliver;
— Ability to scale up operations to provide for contracts won;
— Knowledge about the general requirements that large organisations will have concerning its suppliers;
— Good general marketing, promotional and selling skills;
— Confidence that resources required to commit to making credible bids will over time be matched by an adequate return in contracts won;
— An ability to show that its goods and services can be delivered to consistently high levels of quality; and
— An ability to show that it has a good credit history and all necessary certifications and accreditations.
The services provided in the Lot 3 project will include (but not be limited to) the following:
Outreach work to find Tower Hamlets SME owners who will be willing to register enterprises, currently without fit to supply capability, to take advantage of opportunities provided by the project. Possible means of outreach would include the following:
— Advertising, promotion and networking;
— Forming relationships with organisations dealing with Tower Hamlets SMEs with a view to encouraging such organisations to make referrals;
— Direct contact with individual businesses;
— Creation of a project website and periodic newsletters; and
— Holding events to which businesses are invited and encouraged to consider developing a fit to supply capability of a procurement exercise.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the Contract is communicated to tenderers. Applicant’s who are unsuccessful shall be informed by the Council as soon as possible after the decision has been made as to the reasons why the applicant was unsuccessful. If an appeal has been made regarding the award of the Contract has not been successfully resolved, Chapter 6 of the Public Contracts Regulations 2015 (as amended) provides for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a Contract has not been entered into, the Court may order the setting aside of the award decision or order for any document to be amended and may award damages, make a declaration of ineffectiveness, order for a fine to be paid, and/or order the duration of the Contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the Contract is entered into.
