The provision of works for pitched roofing and associated product projects for public sector organisations in four (4)
regional lots throughout Scotland.
The arrangement will be awarded under two value bands:
SME’s are encouraged to tender for the lower value band (Project value: 5 000 GBP — 250 000 GBP) in 1 or 2 adjoining regional lots.
Larger organisations are encouraged to tender for the higher value band (Project value: 250 000 GBP +) in 1 or more regional lots.
It is envisaged that up to 5 companies will be appointed to each value band in each regional lot.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to provide a reference from their bank.
(2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance.
(3) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.
(4) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.

III.2.3)Technical capacity

Information and formalities necessary for evaluating if the requirements are met:
(1) A statement of the candidate’s average annual number of staff and managerial staff over the previous 3 years.
(2) Details of the educational and professional qualifications of their managerial staff; and those of the person(s) who would be responsible for providing the services or carrying out the work or works under the contract.
(3) All candidates will be required to provide certification from an independent body attesting conformity to environmental management standards in accordance with the Community Eco-Management and Audit Scheme (EMAS); or the European standard BS EN ISO 14001.
(4) All candidates will be required to provide certification drawn up by an independent body attesting the compliance of the economic operator with quality assurance standards based on the relevant European standards.
(5) Certificates drawn up by official quality control institutes or agencies of recognised competence attesting the conformity of products clearly identified by references to specifications or standards.
(6) Samples, descriptions and/or photographs, the authenticity of which must be certified if the contracting authority so requests.
(7) A statement of the principal goods sold or services provided by the supplier or the services provider in the past 3 years, detailing the dates on which the goods were sold or the services provided; the consideration received; the identity of the person to whom the goods were sold or the services were provided.
(8) A check may be carried out by the contracting authority or by a competent official body of the State in which the candidate is established, to verify the technical capacity of the candidate; and if relevant, on the candidates study and research facilities and quality control measures.
(9) A statement of the candidate’s technical facilities; measures for ensuring quality; and their study and research facilities.
(10) An indication of the proportion of the contract which the services provider intends possibly to subcontract.
(11) A statement of the technicians or technical services available to the candidate to carry out the work under the contract; or be involved in the production of goods or the provision of services under the contract; particularly those responsible for quality control, whether or not they are independent of the candidate.

Submission of expressions of interest: Economic Operators wishing to express interest in this framework arrangement are required to complete the Offer Document, which is accessible at LHC’s eTendering portal http://tenders.lhc.gov.uk AFTER this Contract Notice has been published in the OJEU.

SMEs: LHC considers this framework suitable for small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.
Call-off projects may be subject to mini tenders between companies appointed to the arrangement or Direct Award without reopening competition. LHC may introduce secondary tendering processes including electronic processes for call-off projects on behalf of participating bodies.
This framework arrangement is to be procured by LHC and is available for use by LHC Full Member Contracting Authorities and LHC Associate Member Contracting Authorities, together with Local Authorities, Registered Social Landlords and other public sector bodies, including Hospitals, Schools, Colleges, Universities and Police Authorities in

the applicable Regional Lots, as referred to on LHC Buyer Profile www.lhc.gov.uk/Buyer-Profile

The Contractor shall ensure that all contracts with Subcontractors and Suppliers which the Contractor intends to procure following the Commencement Date, and which the Contractor has not, before the date of this Contract, already planned to award to a particular Subcontractor or Supplier, are advertised through the Public Contracts Scotland procurement portal (www.publiccontractsscotland.gov.uk) and awarded following a fair, open, transparent and competitive process

proportionate to the nature and value of the contract.
Under the terms of this contract the successful supplier(s) will be required to deliver Community Benefits in support of the authority’s economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations. The Community Benefits included in this contract are applicable to the type of call-off as agreed between the framework servicing company and the client. This may include.
apprenticeships, community work etc as described in the PR3 ITT.
If insufficient tenders are received for any individual lot that would prevent sufficient companies being appointed to allow a client to run a mini competition when calling off a project, then LHC reserves the right to offer companies who have tendered bids for the same value band in adjacent regions to also have their bid evaluated for regional lots with insufficient tenders, and in that instance any limitation on the number of lots a tenderer can bid for shall be waived, and the invited company will be required to nominate Price Schedules and Tables already tendered for another region to be adopted and evaluated in relation to the additional region. Thereafter standard evaluation and award procedures shall apply.
If there is no appointed company for the contract value or region in respect of the client’s requirements then at call off the client has the option to open the mini competition to and contract with companies appointed to either a similar contract value in an adjacent regional lot or companies appointed to a higher or lower contract value in the same regional lot.

Companies are able to offer community benefits either directly or through apprenticeships. The tender exercise is free to enter, with no additional costs charged by LHC, which is a not-for-profit organisation.
