II.2.1)Total quantity or scope:

Subject to the agreement of the Ministry of Defence (MoD) approving authorities, the permanent joint headquarters (PJHQ) United Kingdom (UK) seeks expressions of interest for the delivery of a range of soft facility management services in support of the British Forces Falkland Islands. It is envisaged that a multi-activity contract will provide a customer focused and fully integrated approach for the provision of soft services in the Falklands Islands.
Due to the nature of this requirement potential bidders must be in a position to bid for the whole requirement and not individual elements, sub-contracting opportunities will be published inline with MoD policy by publishing those companies that are subsequently invited to tender.
It is intended that the duration of the contract will be 4 years with the possibility of upto 2 option years.
Any expenditure, work or effort undertaken prior to Contract award is accordingly a matter solely for the Commercial judgement of the company submitting their bid.
Late or incomplete applications will not be considered.
The authority reserves the right to contract for all, some or none of the stated services.
Service support requirements will include in the first instance, and may not be limited to, for the duration of the contract, the following:
1. Management services;
2. Catering;
3. Retail and leisure services;
4. Accommodation and building services;
5. Cleaning services to include window cleaning, medical cleaning services and laundry/dry cleaning services;
6. Hairdressing services and domestic assistance;
7. Other services (to include pest control and assistance to the royal engineer maintenance support team).

Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a candidate is eligible to be invited to tender.

Candidates will be required to sign a declaration confirming whether they do or do not have any of the listed criteria as part of the pre-qualification process. Candidates who have been convicted of any of the offences under Article 45(1) are ineligible and will not be selected to bid, unless there are overriding requirements in the general interest for doing so.
Candidates who are guilty of any of the offences, circumstances or misconduct under Article 45(2) may be excluded from being selected to bid at the discretion of the Authority.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Authority will initiate a minimum 10 calendar day stand still period at the point at which information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Authority before the contract is entered into. If an appeal regarding the award of a contract has not been successfully resolved, it will be dealt with under the provisions of the Public Contracts Regulations 2006. It provides for the aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into, the Court may make a declaration of ineffectiveness or award damages.
