2. Lot 2 is for the provision of 4 Star Gas works for housing and non-housing stock owned or managed by Basildon Borough Council.
3. Lot 3 is an integrated asset management model which is a combination of Lots 1 and 2.
Participants can apply for all or any of Lots 1 to 3, but as per the above, participants should note that if Lot 3 is awarded, Lots 1 and 2 will not be awarded and if Lots 1 and 2 are awarded as separate contracts then Lot 3 will not be awarded.

II.2.1)Total quantity or scope:

1. Lot 1 — Initially the provision of reactive repairs, external wall insulation (subject to external funding), roofing and roof line repairs and external decoration and environmental improvements with total value circa 8 400 000 GBP excluding VAT for the 1st year. This has the potential to rise to 17 500 000 GBP excluding VAT in Year 2 with the addition of kitchens, bathrooms and electrical works and then to 20 500 000 GBP from Year 3 with the potential addition of window and door replacements and void repairs.

Total potential value — 292 400 000 GBP per annum excluding VAT.
2. Lot 2 — 4 star gas services to include the provision of servicing, breakdowns, LGSR’s and boiler and system installations.
Total value — 2 700 000 GBP per annum excluding VAT in Years 1 and 2 rising to 2 995 000 GBP per annum excluding VAT from Year 3 with the potential addition of communal and district heating maintenance. Total value over 15 years circa 44 335 000 GBP excluding VAT.
3. Lot 3 — Integrated service of Lots 1 and 2 with a potential combined budget in Year 1 of circa 11 100 000 GBP excluding VAT 20 200 000 GBP excluding VAT in Year 2 and circa 23 495 000 GBP per annum from Year 3. This gives a total combined estimated value for Lot 3 of circa 336 735 000 GBP.
Please note following the Government’s 2015 Budget the above figures are likely to be reduced once the impact of the reduced rental income has been fully evaluated by Basildon Council. All though the impact is not fully tangible at this stage some of these budgets could be reduced to 60 % of the stated values.

The Contracting Authority reserves the right to cancel the procurement and not to proceed with the long-term Contract at any stage of the procurement process. The contracting authority also reserves the right not to award a contract. The Contracting Authority nor any person on whose behalf of whom this procurement is undertaken is to be liable for any costs incurred by those expressing and interest or tendering for this contract. Tenderers should note that the provisions of the transfer of undertakings (protection of employment) Regulations 2006 may apply.

Basildon Borough Council will be providing an opportunity for all interested Suppliers to attend a briefing session at the Holiday Inn, Festival Leisure Park, Basildon on Tuesday, 11.8.2015 from 8:00 to 11:00. The purpose of this briefing will be to provide an introduction to Basildon Borough Council, as well as an overview of the procurement process and the objectives of the procurement exercise. VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Contracting Authority will allow a period of at least 10 calendar days between the date it gives to candidates of the decision to award the proposed agreement and the date on which it proposes to conclude the agreement. If by midnight on the 2nd working day of the 10 day standstill period, the Contracting Authority receives a request in writing from a candidate as to why it was unsuccessful, the Contracting Authority is required to provide additional information to the candidate.

That information must be provided at least 3 working days before the expiry of the 10 days standstill period (though the standstill period may be extended, if it is not possible to provide the information in time). Requests for additional information should be sent to the contact in Section I.1) An aggrieved candidate who claims that it has suffered or risked loss or damage as a result of a breach by the Contracting Authority of its duties under the Public Contract Regulations 2015 may take proceedings in the High Court. Any such proceedings must be brought promptly and in any event within 3 months from the date on which grounds for bringing proceedings 1st arose (the Court has discretion to extend the period for a good reason).

If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2015 (provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
