In this present instance, ESPO is working on behalf of Leicestershire County Council and Leicester City Council (the Councils) to undertake a procurement process to identify and appoint a service provider to provide an integrated substance misuse treatment services across the Leicestershire and Leicester City area.
Leicestershire County Council and Leicester City Council are inviting tenders from suitably qualified and experienced organisations that can demonstrate the knowledge, vision, capacity and capability to deliver a comprehensive range of substance misuse services for adults and young people across the different populations and communities in Leicester and Leicestershire.
The Councils wish to adopt a partnership approach to reducing the harms from substance misuse across the administrative areas of Leicestershire and Leicester City. The Office of the Police and Crime Commissioner for Leicestershire (OPCC) and NHS England will also contribute towards this partnership approach.

1. Currently this contract does not include services in the administrative area of Rutland, but Rutland County Council may wish to commission services during the term of this contract. In this case they may approach the successful Service Provider for this contract to deliver services in their administrative area. It is anticipated that the service specification for Rutland will mirror that for the services that are the subject of this contract.2. The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.

Precise information on deadline(s) for lodging appeals: ESPO on behalf of Leicestershire County and Leicester City Councils, will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. Applicants who are unsuccessful shall be informed by ESPO as soon as possible after the decision has been made as to the reasons why the applicant was unsuccessful. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2015 (SI 2105 No. 102) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order for any document to be amended and may award damages, make a declaration of ineffectiveness, order for a fine to be paid, and/or order the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
