This Framework Agreement is for, but no limited to, supply and delivery of grounds maintenance equipment. The Framework Agreement is to provide Scottish local authorities and various other contracting authorities with a mechanism to procure a range of grounds maintenance equipment including but not limited to hand held equipment, pedestrian push equipment, pedestrian self propelled equipment, self propelled mowers, specialist equipment, ride on equipment, pedestrian sweepers and vacuums to maintain amenities such as parks, pitches, golf courses, cemeteries as well as garden and other green spaces. Councils may, if made available, request equipment buy back options and disposal of aged equipment options.

In accordance with Regulation 59(12), as this proposed Framework Agreement is divided into lots, these economic and financial standing selection criteria apply separately in relation to each individual lot.

ESPD (Scotland) Question 4B.5.1 and 4B.5.2 Insurance Requirements:

For all lots it is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:

Employers (Compulsory) Liability Insurance = no less than 5 000 000 GBP in respect of each and every claim.

Public/Products Liability Insurance = no less than 10 000 000 GBP in respect of each and every claim(in the aggregate for Products Liability).

Motor Insurance = RTA cover but with a minimum limit of indemnity of 5 000 000 GBP for third property damage.

ESPD (Scotland) Question 4B.6 Other Economic and Financial Requirements:

A) For bidders who will sub contract parts of the business that might be obtained by it under the proposed Framework Agreement. The bidder should provide a letter signed by a person of appropriate authority within the bidder organisation confirming that the bidder has, or will have prior to the commencement of any subsequently awarded contract, arrangements in place to ensure that sub-contractors are appropriately insured;

B) The bidder is to confirm that a search of the bidder against Equifax’s Protect will not return a “Warning” or “Caution” returnable code or any neutral code, unless the bidder confirms that it can provide any other document which Scotland Excel considers appropriate to prove to Scotland Excel (acting within its permitted discretion under the applicable public procurement rules) that the bidder does / would not represent an unmanageable risk should it be appointed onto the proposed Framework Agreement.

Tenderers will be required to provide a maximum of 3 previous examples of supplies or services carried out in the past three years that they deem appropriate to demonstrate that they have the relevant experience to deliver the supplies or services as described in part II.2.4 of this OJEU Contract Notice.

ESPD (Scotland) Question 4C.10 — Subcontracting:

Tenderers will be required to confirm whether they intend to subcontract and, if so, for what proportion of the contracts to be called-off under the proposed Framework Agreement.

If you intend to subcontract any share of the contract to third parties on whose capacity you do not rely to satisfy the selection criteria, you must secure that each subcontractor completes a separate ESPD (Scotland) Response for Parts 1, 2, 3 and 6 of the ESPD (Scotland) Qualification Envelope.

Tenderers are advised whether electronic ordering, invoicing and payment will be used or accepted is at the discretion of each Scotland Excel Local Authority Member or Associate Member which will be settled by them during the procedure for the call-off of a contract under this proposed Framework Agreement.

Regulation 72

In line with Clause 72 of the Public Contracts(Scotland)Regulations 2015, Contract and Framework Agreements may be modified without a new procurement procedure in accordance with this Part in some cases. Further details of the cases this is permitted is in the “09-18 Regulation 72” document in the “Information and Instructions” folder.

The Council reserves the right to use an electronic auction for its Call-offs during the Contract period

Electronic auctions may be used when competition is re-opened for purposes of awarding a Competitive Order. If required, the Council will issue information on how they will operate.

Contract Management, KPIs and Community Benefit Requirements

As per the Special Conditions, Suppliers will be required to provide Management Information(MI) and KPIs on a quarterly basis and report on Community Benefits bi-annually.

MI requires an itemised statement for goods provided for each contracting authority set out in the template.

In addition, details on the following KPIs must be provided:

Customer complaints: Number “No” of complaints received;

Delivery times: No of late deliveries;

Product returns: No of Goods returned due to substandard quality; and,
