II.1.5)Short description of the contract or purchase(s)

Falkirk Council is looking to establish a Framework Agreement with up to 5 experienced Service Providers to transport Social Work Services Service Users from a departure location to a designated drop off location (within and/or out with Falkirk)on designated days of the week and times of the day. Journeys may be on an adhoc or set journey basis.
The Service Provider shall provide the Services detailed in Schedule 3 — Specification to Service Users determined by the Council, to various locations within Falkirk Council or destinations within other local authority areas, for new referral journeys.
The Framework is split into 2 Lots:
Lot 1 — Set journeys and ad hoc journeys from and to anywhere in Falkirk;
Lot 2 — Set journeys and ad hoc journeys from anywhere in Falkirk to a location in another local authority area.
Bidders may bid for 1 or both Lots.

Precise information on deadline(s) for lodging appeals: Falkirk Council will incorporate a minimum of 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. If an appeal regarding the award of contract has not been successfully resolved, the Public Contracts (Scotland) Regulations 2012 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the court may only award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the courts to set aside the award decision before the contract is entered into).
