III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: An economic operator will be ineligible for participation in the tender process where the economic operator or its directors or any person who has powers of representation, decision or control of the economic operator has been convicted of any of the offences listed at regulation 26 paragraph 1 of the Utilities Contracts Regulations 2006 as amended by subsequent legislation, such ineligibility being subject to paragraph 2 of regulation 26).
An economic operator may be judged ineligible for participation in the tender process where any of the grounds set out at Regulation 26 paragraph 5 of the Utilities Contracts Regulations 2006 as amended by subsequent legislation applies to the Economic Operator. Economic operators responding to this notice shall provide written confirmation as to their status with respect to the matters set out in paragraphs 1 and 5 of regulation 26.

Note: Each of the following requests for information is directed toward the Applicant; where the Applicant is an unincorporated joint venture or consortium then response should be made by the Lead Entity; where the Applicant is an incorporated joint venture then responses should be given for the joint venture.
a) Turnover for the last three complete financial years in respect of:
i. The Applicant*.
ii. The Applicant’s ultimate parent company if applicable.
b) Three years audited accounts sufficient in terms of type and detail of information to permit evaluation of:
i. Liquidity (Acid Test Ratio).
ii. Gearing (Long-term Leverage Ratio).
iii. Bank Leverage Ratio.
iv. Payments Period (Creditor Days Ratio).
c) A formal statement that you are not aware of any reason why you would not comply with your banking ratios.
LLAGL reserves the right to obtain further financial information if required in connection with the evaluation of the Applicant’s financial standing.
ASSESSMENT a) Turnover — A MINIMUM TURNOVER of £15 million for each of the three years is required as a pass/fail criterion (absolute). However, where an Applicant has not met this turnover threshold and has a parent company, the parent company’s turnover will be taken into account with regard the application of threshold turnover if the Applicant confirms (stating in his response to this Notice) that its parent company will, if called upon to do so, enter into a Parent Company Guarantee (PCG)
ASSESSMENT b) and c) — pass/fail (subject to evaluation). The financial information will be assessed to determine the Applicant’s financial stability and the degree of risk the Applicant’s financial status poses to the Contracting Entity in terms of its ability to deliver the works. Applicants will be assessed qualitatively as low, medium or high risk on the basis of the data provided. In addition, a credit/risk agency may be used as part of the financial assessment process.
If an Applicant is considered to offer a significant risk, the Applicant will be invited to discuss LLAGL’S concerns and provide further documentation before any decision to award a fail was taken.
INSURANCES

In the event that your cover does not meet the levels set out below, please confirm that you will take out, if required by LTN, insurances to meet the following minimum requirements:

EXPERIENCE
Each of the following questions / requests for information is directed toward the Applicant; where the Applicant is an unincorporated joint venture or consortium then response should be made by the Lead Entity; where the Applicant is an incorporated joint venture then responses should be given for the joint venture or otherwise for that constituent of the joint venture (stating which) whose experience best satisfies the requirements of the project.
a) Provide UP TO three examples of projects you have undertaken within the last 10 years that concern multi-storey car parks or otherwise (in the absence of such projects) provide details of projects which you consider to be similar in their nature and requirements to the proposed works. Particular emphasis should be given, where possible, to projects which required delivery to a restricted timescale in a busy environment requiring the maintenance of public access and perking on a 24/7 basis immediately adjacent to the site and the minimisation of disruption to existing parking adjacent to the footprint of the site.
Each of the examples should provide the following information:
i. Name and location of the works.
ii. The Applicants role in the design and construction of the works.
iii. A description of the works and how you delivered them (including the design function) including:
— The superstructure / structural frame option adopted.
— The cladding employed.
— The control equipment and mechanical and electrical services incorporated into the works.
iv. How you managed risk on the project including mitigation and how you met any design and construction challenges inherent in the project.
v. The year completed or, if ongoing, anticipated completion.
vi. Approximate value of project and number of parking spaces created.
vii. Client / employer’s details.
viii. Type of contract employed.
ix. An indication of project out turn against budget and programme with reasons, if applicable, where the outturn varied by more than 5 % from the contract price.
x. Details of any innovative working and/or value engineering.
xi. Awards or citations received in connection with the project.
xii. References in respect of each project cited.

ASSESSMENT — The responses to the experience section will be scored and will attract up to 90 % of the available marks. Applicants should note however that AT LEAST ONE OF THE EXAMPLES PROVIDED MUST CONCERN THE DESIGN AND CONSTRUCTION OF A MULTI STOREY CAR PARK WHERE THE APPLICANT WAS (OR IS CURRENTLY) PRIMARILY RESPONSIBLE FOR THE DELIVERY OF THE PROJECT WORKKS — THIS STIPULATION FUNCTIONS AS A PASS/FAIL REQUIREMENT.
