Frequency and value of the contracts to be awarded: It is anticipated that on a quarterly basis, a mini-competition process will be used to award requirements for general tree works. Emergency tree works will be on a direct award basis. Framework Contractors will be ranked on the basis of their overall score. When emergency works are required, the Contractor ranked in 1st place will be contacted and asked to attend within 1 hour. If the Contractor ranked in 1st place is unable to attend to the emergency or is unable to be contacted, the Contractor ranked in 2nd place will be contacted and so on.

II.1.5)Short description of the contract or purchase(s)

Erewash Borough Council (‘The Council’) is establishing a framework for the provision of Tree Works (Arboricultural Services), including hedge pruning, stump removal and re-instatement. It also includes the provision of emergency tree works to address situations where for example a tree is at risk of failing or a tree is blocking a road, etc. In the event of emergency tree works being required, Contractors Must be able to attend site within one (1) hour of receiving notification from the Council.
In order to be considered for this Contract, Suppliers must hold and maintain for the lifetime of the Contract, membership of the Arboricultural Association Approved Contractors Scheme (ArbAC).
The Contract is anticipated to start on 6.8.2016 for an initial period of 3 years. There is an option to extend the contract for a further 12 month period subject to funding, business need and satisfactory performance.

Indicative volumes are as stated within the invitation to tender document. The Council does not guarantee any minimum volume of work. The estimated annual value is 105 000 GBP. Total value for initial 3 year period is 315 000 GBP. Total value over maximum 4 year period is 420 000 GBP.

Precise information on deadline(s) for lodging appeals: Erewash Borough Council will incorporate a minimum 10 calendar days standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the contact details provided in section 1.1) of this notice. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages. The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into.
