Angus Council is inviting organisations who can provide personal care and/or a housing support (including home based respite services) registered service (Registered with the Care Inspectorate)to people in Angus to tender for these services. The aim is to establish a multi-supplier framework.
The main aim of any support provided is to enable individuals to be supported to live where they want to live and feel safe, to be treated with respect and dignity and maintain or improve the skills they need to remain in their own home if this is what they want.
Services provided may include personal care services and housing support services and could also be provided as home based respite for a carer as well as the individual receiving services. (Please refer to Service Specification under the ‘Additional Information’ section of this Notice.

Focus of this Procurement:
The Social Care(Self-directed Support)(Scotland)Act 2013 which has an implementation date of April 2014 introduces a duty on local authorities to offer those with eligible needs greater choice and control over the support to meet their needs.

As at 15.1.2014 (Estimated Hours):
Angus Council currently commissions up to 3309 hours of personal care and housing support per week from external Providers.
Up to *8 319 hours personal care and/or housings support hours
Additionally, Angus Council currently commissions up to up to 3 834 hours (not counted in the *8 319 hours)which are recorded as Therapeutic Services
(the number of Therapeutic hours may be overestimated as it includes 24 hour supported accommodation based support) which is out with the scope of this tender.
The estimated value of this spend is approximately GBP 6,38 million per year.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

III.2.2)Economic and financial ability

Minimum level(s) of standards possibly required: (i) Economic and financial standing – Applicants must demonstrate that they are financially robust. All tenderers should provide 3 full years’ data which will be available from the 2 years’ audited accounts provided. Applicants should note that unaudited current financial year information will only be taken into account for this purpose if (a) the council is satisfied as to its reliability and (b) it relates to a full 12 month period;
(ii) Economic and financial standing – Applicants should also demonstrate that they have revenue reserves at the close of their most recent audited accounts of no less than 10% of the average annual turnover calculated over the same 3 year period as is referred to in clause (i) above subject to a maximum requirement (i.e. the upper revenue reserves value limit beyond which the stated % will not apply) of GBP 1 000 000;
(iii) Note – Where an organisation is a start-up organisation or is otherwise unable to satisfy the reserve requirement set out in clause (ii) above) they must provide independently and reliably verified information that will confirm the robustness of their financial position to the Council whose assessment thereon will be final.
Economic and financial standing, namely: Suppliers must hold or commit themselves to holding prior to the date of contract award the following minimum insurances with a reputable insurance company:
Employers’ liability insurance to the extent of at least GBP 10 m each and every claim and unlimited in total;
Public / product liability insurance to the extent of at least GBP 5 m each and every claim and unlimited in total;
If it is identified that a supported person is assessed as requiring health care tasks and a Provider is able to meet those outcomes, in respect of the delivery of those health Care Tasks or medication requirements, Providers will require to demonstrate to Angus Council that their existing liability policies indemnify them for carrying out such tasks and where this cover is not in place, Providers must arrange the appropriate extension to their liability policies. This must be done prior to commencement /delivery of these tasks.
Comprehensive Vehicle Insurance for Fleet Vehicles
Comprehensive Vehicle Business and Passenger Insurance where vehicles are used to provide Supported Persons’ agreed ‘Outcomes’.
