It is intended that on completion of the tender exercise that the successful tenderer will enter into separate contracts with each of Wiltshire Council and Swindon Borough Council. Each contract will be on the same terms with the same specification although there will be different minimum spend commitments for each contract and TUPE and Pension provisions will be substantially different in each.

1. Summary of Project.
Project Name: Wiltshire and Swindon Highways Contract.
Lead Manager: Project Manager.
Service cost (excluding VAT): Anticipated annual spend 15 000 000 GBP.
Main Contract type: Construction, Foundation and surface works for highways and roads.

Anticipated start on site date: 2nd Quarter 2016.

Anticipated duration: 60 including mobilisation.
Award criteria: Restricted tender MEAT.
2: Overview of Procurement Exercise.
Pre-qualification questionnaire (PQQ)
The first step to awarding the contract is the completion and submission of the pre-qualification questionnaire (PQQ). The PQQ has been designed to assess the suitability, economic and financial standing and technical and professional ability of the companies expressing interest.
The PQQ comprises 15 Sections that is A-O. Section A and B1 are for information only, whiles section D: Health and Safety Policy and Capability and G: Quality Management Policy & Capability are assessed according to Pass/Fail criteria.
The remainder of the submissions will be scored in accordance with the scoring criteria outlined in within the PQQ document. A score on 2 answers of 0 shall result in the Applicant being disqualified from the Tender Selection Process.
Up to 6 companies achieving the highest scores at the PQQ shall be invited to tender.
Invitation To Tender (ITT).
The ITT stage will comprise of Quality/technical questions and commercial sections which tenderers will be required to response. The quality/technical questions are grouped under two parts following criteria:
— Part 1 — Additional supplementary information.
— Part 2 — Quality question responses which will be scored.
This comprises 5 Sections:
a — Management Arrangements.
b — Systems and Processes.
c — Operations and Methods.
d — Customer Care.
e — Performance, Innovation and Efficiency.
Tenderers are required to provide complete and concise response within stated page limits (please note that page limits are maxima, not targets). Page limits must be adhered to and responses that exceed specified limits will be marked Zero
Following the receipt of the Tenders, all 6 shortlisted Tenderers may be required to attend an interview with the Councils Tender Evaluation Panel. The interviews shall be scored and added to the quality and finance score to determine the final score.

The cost of responding to the pre-qualification questionnaire (PQQ) and any subsequent tender information and / or participation exercise in the procurement process generally will be borne solely by the economic operator participating. Economic operators should note that the Contracting Authority reserves the right to cancel this procurement process at any stage. Any expenditure, work or effort undertaken prior to the contract award is at the sole risk of the economic operator participating in this procurement process. All discussions and correspondence will be deemed strictly ‘subject to contract’ until a formal contract is entered into. The formal contract shall not be binding until it has been signed and dated by the duly authorised representatives of the parties. Any date given in Section IV) above is a best estimate at the time of dispatch. The Contracting Authority reserves the right to extend any such date.

Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10 day standstill period at the point information on the award of Contract is communicated to tenderers. This period allows unsuccessful tenderers to seek a further debriefing before the Contract is entered into. If an appeal regarding the award of Contract cannot be resolved, the Public Contract Regulations 2015 provides for aggrieved parties to take action in the High Court (England, Wales and Northern Ireland). Any such action should be brought promptly (generally within 30 days).
