Invitation to Tender available from South East Business Portal (see website above). Information on employees on current contract who would transfer to a new contractor under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (as amended) is ONLY available from contact officer (details above) due to data protection requirements. Requests for clarification should be sent in by no later than 16:00 on 3.9.2015. Having evaluated each option, the Council will select the option that is the most economically advantageous tender for which budget provision can be made. If a contract of 5 years is selected, there will be an option to extend for a further 2 years. Tenders must be submitted by post and electronic submission will not be accepted. Electronic invoicing will be accepted and electronic payment will be used.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum 10 calendar day standstill period when information on award of the contract is communicated to tenderers. During this period, unsuccessful tenderers may seek further debriefing from the Council. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the address detailed in I.1 Aggrieved tenderers may take action in the High Court (England, Wales or Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into).
