The anticipated scopes of works includes investment in the principal buildings within Devonshire Park including refurbishment and renewal of the three theatres to maintain their architectural quality. Replacement of the existing conference, event and multipurpose spaces with a new welcome centre. New tourism and visitor information services so as to reinforce the visitor offer and make the Park a premier cultural destination. New café, bar and possible restaurant solutions to serve both destination visitors and wider markets. New and improved tennis tournament facilities across the Park including improving the tennis centre and court provision and layout. Improved public realm and landscaping to the Park and the surrounding area.

Section III: Legal, economic, financial and technical information
Any supplier may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal organisation, as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention of the use of the financial system for the purpose of money laundering.
(2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance.
(3) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.
Section IV: Procedure
Objective criteria for choosing the limited number of candidates: The PQQ sets out the information which is required by the Council in order to assess the suitability of consultants in terms of technical knowledge and experience, capability and financial standing to meet the requirement. During the PQQ stage, the intention is to arrive at a shortlist of 5 (five) and maximum of 8 (eight) qualified providers for each Lot for formal Invitation to Tender.
Section VI: Complementary information
Applicants will be required to complete a pre-qualification questionnaire available from the South East Business Portal at www.businessportal.southeastiep.gov.uk by the time/date indicated in IV.3.4. Questionnaires should be completed for return by no later than 4.00 pm on 7.5.2014 to the following email address: DPdesignservices@eastbourne.gov.uk.
Any requests for clarifications must be provided by 4.00 pm on 28.4.2014.
The estimated start date of the contract is August 2014.
The contracting authority undertake to use reasonable endeavours to hold confidential any information provided in the proposal submitted, subject to the contracting authority’s obligations under law, including the Freedom of Information Act 2000. If the applicant considers that any of the information submitted in the proposal should not be disclosed because of its sensitivity then this should be stated with the reason for considering it sensitive. The contracting authority will then consider the sensitivity statement before replying to any request received under the Freedom of Information Act 2000.
Those invited to tender will be selected on the basis of the relevant EU public procurement directives and United Kingdom regulations as regards their financial standing, their technical capacity and ability, and other permitted grounds.
When executing the contract within the United Kingdom, the successful service providers will be required to comply with the recommendations of the Code of practice for the Elimination of Racial Discrimination and the promotion of Equality of Opportunities, published by the Commission for Racial Equality, obtainable on request from the City Council. The service providers will also be required to comply with the requirements of the Disability Discrimination Act 1995. Further information on the Council’s requirements on the aforementioned will be included in the invitation to tender documents.
